Submitted By: Terry Griffith griffith_terry1@yahoo.com James Whitehead State of Kentucky County of Leslie On the 14th day of March A.D. one thousand eight hundred and eighty one personally appeared before me a clerk of the Leslie County Court, a court of Record within and for the County and State aforesaid, SAMUEL MOSLEY, a resident of the County of Leslie and State of Kentucky who, being duly sworn according to law, deposes and says, that he is 46 years of age, that he has known JAMES WHITEHEAD all his Whitehead’s life and that he is the identical Whitehead that enlisted in the service of the U.S. in the war of 1861 in Company H of the Kentucky Infantry Volunteers commanded by Captain J.J. Black, 49thth Kentucky commanded by Colonel John Eve and was discharged at Lexington, Ky.. He says that prior to his entry in the service that applicant was in good health but that ever since he returned home from since service that applicant with bleeding at the lungs and with chronic diarrhea. He says that he is not of kin to applicant and that he is not interested in the prosecution of this claim. PRIOR SOUNDNESS Samuel Mosley a resident of Leslie County, Kentucky, affidavit filed March 21st, 1881, testifies that he has been acquainted with claimant all is life, he was a stout able bodied man previous to enlistment. SINCE DISCHARGE Samuel Mosley a resident of Leslie County, Kentucky, affidavit filed March 21st, 1881 testifies that he is intimately acquainted with claimant; he has been afflicted with disease of the lungs and chronic diarrhea since he left the U.S. Service. CLAIMANT’S STATEMENT Affidavit filed (March 21, 1881) Claimant states that he contracted disease of the lungs and chronic diarrhea December 26th, 1864, has had both disabilities since the war. Since leaving the service have resided in Leslie County, Kentucky. He further states his occupation is compulsory idleness from his physical disabilities. Affidavit filed (July 18th,1881) claimant further states his residence has always been Manchester, Clay Co., Ky, he first contracted chronic diarrhea at Camp Nelson, Ky., was not able for duty except at intervals, was treated by Dr. Mille, Surgeon of my Regiment, have not been able to perform manual labor except at times. Have also been affected by pains in my chest; have not been treated by any physician for either of the above disabilities since he left the service. He further states he is not able to perform manual labor, has been prevented for from (10) to (60) at a time. James X Whitehead State of Ky., Leslie County This day personally appeared before me, Clerk of the County Court for and in this County- the same being a court of record, JAMES WHITEHEAD, who, after being duly sworn, deposes and says: “My residence has always been that of Manchester, Clay Co., Ky., until the formation of this, Leslie County, since which time it has been that of Hyden, Leslie County, Ky., and am a farmer by occupation. I took chronic diarrhea while in the service at Camp Nelson, Ky. I was so affected that I was unable for duty except at intervals while in the service of the United States. I was treated by one Dr. Miller, Surgeon of my Regiment- residence not known. I have not been able for labor except- at times since I incurred the disease- its still following me in its most malignant form ever since I was first affected while in the service. I was first affected while in the service of the U.S.A. I have also been affected with pain in my chest since the inception of my disease or very soon thereafter. I have not been treated by any physician for either the diarrhea or pain in my chest since I was mustered out of the service. I have not performed on account of said disease, any manual labor of notice other than little at intervals when I would recover from my periodical attacks. DECLARATION FOR AN INVALID PENSION State of Kentucky County of Leslie On this 14 day of March A.D., one thousand eight hundred and 81, personally appeared before me, Clerk of the Leslie County Court, a court of record within and for the County and State aforesaid, JAMES WHITEHEAD, AGED 35 years, a resident of the County of Leslie in the State of Kentucky who, being duly sworn according to law, declares that he is the identical James Whitehead, who, volunteered in the service of the United States In Clay County in the State of Kentucky, on or about the 3d day of June in the year 1863, as a Volunteer in Company H commanded by Captain J.J. Black in the 49 Regiment of Kentucky Infantry Volunteers, commanded by Jno. Eve, in the war of 1861, and was honorably discharged at Lexington in the State of Kentucky, on or about the 26th day of December in the year one thousand eight hundred and 64, that while in the service aforesaid, and in the line of his duty, that he became afflicted with hemorrhage of the lungs and chronic diarrhea: the above named afflictions ever since the war and still continues so I am still afflicted. That since leaving the said service, this applicant has resided in the County of Leslie in the State of Kentucky and his occupation has been compulsory idleness from physical inability to perform labor. That prior to his entry into the service above named, he was a man of good, sound physical health, when enrolled, a farmer. That now he is entirely disabled from obtaining his subsistence from manual labor in consequence of his above named injuries received in the service of the United States. He makes this declaration for the purpose of being placed on the Invalid Pension Roll of the United States, by reason of the disabilities above stated, and revoking and countermanding all other authority that may have been given, he hereby constitutes and appoints, with full power of substitution and revocation himself his true and lawful attorney, to prosecute his claim, and obtain the pension certificate that may be issued. Melton, Clerk Leslie County Court EXAMING SURGEON’S CERTIFICATE No. of Application, 418,558 State Kentucky, County: Clay Post-Office: Manchester, June 14, 1882 I hereby certify that I have carefully examined JAMES WHITEHEAD, late a private, Company H, 49 Regiment, Kentucky Volunteers in the service of the United States, who is an APPLICANT for an invalid pension by reason of alleged disability resulting from disease of lungs and chronic diarrhea. In my opinion the said James Whitehead is not incapacitated for obtaining his subsistence by manual labor from the cause above stated. Judging from his present condition, and from the evidence before me it is my belief that the said disability did not originate in the service aforesaid in the line of duty. The disability is **** A more particular description of the applicant’s condition is subjoined: Height, 5-10; weight, 160; complexion, dark; age, 36; pulse, normal; respiration, normal Applicant according to his own statement suffers from Constipation alternating with diarrhea- due in all probability to irregular habits- no disability- applicant alleges cough and the occasional spitting of blood, but I find none of the characteristic signs accompanying such a condition, he having a well developed chest and muscular system fairly nourished. Absent, no remark- transferred to Company H same Regiment and taken up, present, on roll for November and December 1863 with remark. Transferred from Company G, December 14, 1863; January and February, March and April 14 present; May and June - dropped, as deserted June 18, 1864; muster out roll of Company reports him deserted at Camp Burnside, Kentucky June 18, 1864. Return for October, reports him- furloughed September 20th for 18 days, not yet returned. Company and Regiment books not on file, Cause of absence for which furloughed not stated- no evidence of alleged disability. Return November same reports as October. Webb, of Washington, D.C. the fee of twenty-five dollars, which shall include all amounts to be paid for any services in the furtherance of said claim, and said fee shall not be demanded by or payable to my said agent in whole or in part, except in case of the granting of my pension by the Commissioner of Pensions, and the same shall be paid to him in accordance with the provisions of sections 4768 and 4769 of the Revised Statutes, US. 1. Black and was honorably DISCHARGED at Lexington, Kentucky on the 26 day of December, 1864, that his personal description is as follows: Age 43 years; height 5 feet 8 inches; complexion light; hair light; eyes blue. That while a member of the organization, aforesaid, in the service and in the line of his duty at Point Isabella, in the State of Kentucky on or about the 25 day of November 1863 he contracted a cold which settled on his lungs and from which he continues to suffer. That he has not been employed in the military or naval service otherwise than as stated above That since leaving the service this applicant has resided in the County of Clay and Leslie in the State of Kentucky, and his occupation has been that of a farmer. That prior to his entry into the service above named he was a man of good, sound, physical health, being when enrolled a farmer. That he is now greatly disabled from obtaining his subsistence by manual labor by reason of his injuries, above described, received in the service of the United States; and he therefore makes this declaration for the purpose of being placed on the invalid pension roll of the United States. My personal description is as follows: Height 5 feet 8 inches; complexion light; color of hair black and of eyes black. I am married; my wife’s name is Amie Whitehead My place of residence since the war have been; from about 1865 to about 1878, in Clay County, State of Kentucky, my P.O. address being Manchester, Kentucky, from about 1878 to about 1890, in Leslie County, State of Kentucky, my P.O. address being Hyden, Kentucky. The following is a full and complete statement of all the service ever rendered by me in the military or naval service of the United States: I enlisted at Home, on the 27th day of June 1863, to serve one year, in Company (H) of the 49th Regiment of Kentucky Volunteers and was honorably discharged there from at Lexington, Kentucky on the 26th day of December 1864 I now have the following injuries, diseases, or disabilities, each was caused or incurred as stated opposite thereto and neither of which is the result of vicious habits on my part: Name of Disease What part of body what caused it? Howard, Clerk Leslie County Court DECLARATION FOR INVALID PENSION State of Kentucky, County of Leslie, On this 30th day of May A.D., one thousand eight hundred and ninety three, personally appeared before me, a Deputy County Court Clerk of the County Court, within and for the County and State aforesaid, JAMES WHITEHEAD, aged 48 years, a resident of the Hoskinston, County of Leslie, State of Kentucky, who being duly sworn according to law, declares that he is the identical James Whitehead who was enrolled on the 27 day of June 1863, in Company H, 49th Kentucky Infantry in the service of the United States in the War of the Rebellion, and served at least ninety days, and was honorably discharged at Lexington, Kentucky on the 26 day of December, 1864. That he is unable to earn a support by manual labor by reason of Diarrhea and bleeding at lungs. The said disabilities are not due to his vicious habits, and are to the best of his knowledge and belief of a permanent character; that he has before applied for pension under application No. 418,558 That he has not been employed in the military or naval service otherwise than as stated above That he makes this declaration for the purpose of being placed on the pension roll of the United States under the provisions of the Act of June 27, 1890. He hereby appoints, with full power of substitution and revocation, William Fitch & Co., of Washington, D.C., his true and lawful attorney, to prosecute his claim, and to receive therefore a fee of ten dollars; that his Post-Office Address is Hoskinston, County of Leslie, and State of Kentucky James X Whitehead Attest: mark John R.
