Civil War Pension File Waid Volentine DECLARATION FOR ORIGINAL INVALID PENSION State of Kentucky Leslie County On this 9th day of October A.D. one thousand eight hundred and eighty three personally appeared before me, Wooton, Clerk of, a Court of Record within and for the County and State aforesaid WAID VOLENTINE aged 40 years, a resident of Chavies, County of Leslie, State of Kentucky, who, being sworn according to law, declares that he is the identical Waid Volentine who was enrolled on the 15th day of December 1862 in Company H of the 14th Regiment of Kentucky Cavalry Volunteers commanded by Captain Hiram Shaw and was honorably discharged at Camp Nelson, Kentucky on the 24th day of March, 1864; that his personal description is as follows: age 40 years; height 5 feet 6 inches; complexion fair; hair black; eyes blue. That while a member of the organization aforesaid, in the service and in the line of his duty at Irvine, Kentucky in the month of ? 1863 from severe exposure he contracted disease of lungs from which I have never recovered. He is disabled from manual labor two thirds of the time thereby and he claims pension on account- of disease of lungs, and right shoulder rising from vaccination caused disability same- from exposure. That he was treated at my quarters or tent By Dr. John M. Daniel who is now dead. That he has not been employed in the military or naval service otherwise stated above. That since leaving service this applicant has resided in Kentucky, and his occupation has been that of farmer. That prior to his entry into the service above named he was a man of good, sound physical health, being when enrolled a farmer. That he is now greatly disabled from obtaining his subsistence by manual labor by reason of his injuries above described, received in the service of the United States; and he therefore makes this declaration for the purpose of being placed on the pension roll of the United States. Wooton, Deputy Clerk, Leslie County Claimant’s Affidavit State of Kentucky County of Perry In the pension claim of WADE VOLENTINE, Late of Company H, 14th Regiment Kentucky Volunteers, No. 499.808 The Claimant Wade Volentine personally came before me a Justice of the Peace in and for aforesaid County and State, a citizen of the County of Perry and State of Kentucky who being duly sworn declares in relation to the aforesaid case as follows: I am a resident of Perry County, Kentucky, P.O. Chavies, my occupation was for five years preceding my enlistment was a farmer and has been ever since my discharge to the present time. I became diseased in the year of 1863 while a soldier I was vaccinated in my right arm in 1863 and it affected my shoulder and breast and raised and run under my arm and in my breast. Dr. J M Daniel treated me for it. Dr. J M Daniel is now deceased. My breast and shoulder has always hurt me since that time and also my hip and back about the month of August 1867 I was attacked with a severe pain in my breast, side and right arm and shoulder, the severity of it only lasted one night, but was bad off for several days. I hadn’t any doctor while so bad, but was treated by Dr. W B Feltner after the severe stage was over. I suffer very badly with misery in my breast and shoulder, back and hip when I labor sometimes a great deal worse than other times. I have been treated at intervals at various times by Dr. W B Feltner, but cannot give accurate dates of treatment. I have labored some on a farm as much as was able. I have not been able to do hard labor without being in great pain. I am not able to labor more than one third of my time without being in great pain and suffering from my diseases. I am uneducated and I got a man to write out an affidavit for this and I misunderstood the questions and stated that there was no doctor that treated me, but J M Daniel I thought at the time it was while in the army. Since that time I have been informed that it was for the treatment since my discharge therefore I had this wrote out in it instead this and the affidavit of Dr. W B Feltner shows that I have been treated by him since my discharge which is correct, but when I give the other affidavit I thought the question was for the treatment while a soldier. Personally came before me a Justice of the Peace in and for aforesaid County and State, JOHN C. HUFF, aged 44 years and JOHN LANGDON, aged 44 years, citizens of the town of Shoal, County of Perry, State of Kentucky, well known to me to be reputable and entitled to credit, and who, being duly sworn, declare in relation to aforesaid case, as follows: The affiant JOHN C. HUFF states that has been acquainted with the claimant WADE VOLENTINE for five years previous to his enlistment and as far as I know he was a healthy man up until that time and have also known him ever since and lived about four miles of his residence and have worked with him very frequently and at various times I have heard him complain of his shoulder, side and breast and I don’t believe he able to perform more than half manual labor. The affiant JOHN S. LANGDON states that he has been acquainted with claimant WADE VOLENTINE for about 30 years and has lived about 3 miles from his residence and the time he was a healthy man until he enlisted in the service and since that time I don’t think his health has been good. Ever since I was with him in the service and he was sick at various times and at the time and the time he don’t seem to be able to perform more than half manual labor. John C. Huff John S. Same report to October 31, 1863 (last on file). Regimental returns prior to August 1863 are not on file. Returns for September, October, November, December 1863 do not report him absent. Returns for January 1864 (last on file) reports him present on extra daily duty. Mustered out with the Company at Camp Nelson, Kentucky March 24, 1864. The name Wade Volentine not borne on rolls for Company H, 14th Kentucky Cavalry on file in this office. No evidence of alleged disabilities. Assistant Adjutant General State of Kentucky Perry County In the matter of Invalid Pension Claim No. 499.808 of WADE VOLENTINE, Private Company H, 14th Kentucky Cavalry personally appeared before me a Clerk in and for County and State aforesaid, WADE VOLENTINE who being by me duly sworn according to law declares in relation to the aforesaid case as follow: In the year 1862 I enlisted in the U.S. Army a sound man and during the late war I contracted disease of the lungs and was vaccinated which caused a stiffness of right shoulder which has give me more or less pain ever since my discharge from the army and are both gradually growing worse and I am now almost entirely unable to perform manual labor and give myself justice for when I lay down at night after exerting myself ***** during the day. I cannot sleep for smothering and pains from said disease. I further state that I enlisted and fought in good faith and am now unable to make my support by manual labor and am a poor man and that is the only means by which I had to make my support. Who being duly sworn according to law state that he is well acquainted with the claimant Wade Valentine who is a applicant for Invalid Pension and knows that the said Wade Valentine to be the identical person of the name who enlisted as a Private in Company H, 14th Regiment of Kentucky Cavalry Volunteers that said claimant was discharged on the 24th day of March 1864 by reason of expiration of term of enlistment, that said claimant while in the line of his duty on or about the latter part of December 1862 that the claimant was vaccinated he became very sick and claimant’s complained and looked very bad. Also claimant has a very bad breaking out on his body and breast and shoulders, the claimant contracted said disease at Irvine in Estill County, Kentucky. I know that after claimant contracted the aforesaid diseases that it was a long time before he was able to do anything. James Marcum, Clerk Clay County Court PROOF OF DISABILITY State of Kentucky, County of Leslie On this 1st day of August, A.D. 1887, personally appeared before me a County Court Clerk in and for the aforesaid County, duly authorized to administer oaths DELANEY BARGER aged 49 years, whose post office address is Hyden, Leslie County, Kentucky who being duly sworn according to law, states that he was acquainted with Waid Volentine applicant for Invalid Pension; and knows the said Waid Volentine to be the identical person of that name who enlisted or volunteers as a Private in Company H, 14th Regiment of Kentucky Volunteers and who was discharged at Camp Nelson on or about 24th day of March 1864 by reason of expiration of term of service. That the said Waid Volentine while in the line of duty, at or near Irvine, Kentucky in the State of Kentucky did, on or about the _ day of December 1862 become disabled in the following manner, viz: that claimant was vaccinated in the right arm and it served to give him great pains by rising which was resulting in fever and he was very much disabled. That the facts stated are personally known to me by reason of being a Sergeant of Company I, 14th Kentucky Cavalry and after being with said claimant he stilled continued complaining until about the month of March 1863 when said claimant started aching I know and the next time affiant saw said claimant he was still in bad health and shortness of breath similar to palpitation of heart. Claimant still continued in bad health till he was mustered out and further states said claimant has still continued in bad health. Affiant often sees said claimant. And deponent further states that he is well acquainted with the claimant, having known him for at least 35 years and further that his knowledge of the facts stated derived from said acquaintance, and from having served as Sergeant of Company I, of the 14th Regiment of Kentucky Cavalry Volunteers, from the 15 say of October 1862, to the 24 day of March 1864. Howard, a County Court Clerk in and for the County and State aforesaid, WADE VALENTINE, aged 48 years, a resident of the County of Leslie, State of Kentucky, who being duly sworn according to law, declares that he is the identical Wade Valentine, who entered service during the War of the Rebellion under the name of Wade Valentine on or about the 15 day of December, 1862, as Private in Company H of the 14th Regiment of Kentucky Cavalry commanded by Captain Hiram Shaw and was honorably discharged at Camp Nelson, Kentucky, on or about the 24th day of March, 1864, by reason of expiration of term of enlistment; that his personal description is as follows: age 48 years; height 5 feet 6 inches; complexion fair; hair dark; eyes blue. That he is now suffering from rheumatism in back and the arms and shoulder and back and left hip also from left lung and side and right eye and that the said disability is of a permanent character, and is not the result of vicious habits, and that its incapacitates him from the performance of manual labor in such a degree as to ender him unable to earn a support, and that this declaration is made for the purpose of being placed upon the pension roll, under the provisions of the Act of June 27, 1890. That he has not been employed in the military or naval service otherwise than as stated above. That he believes himself to be entitled to an increase of pension on account of increased severity to the rheumatism for which he now draws pension and for palpitation of the heart, the said palpitation giving him great trouble and rendering him at times unable to obtain sleep and hereby appoints, with full power of substitution and revocation, W B Eversole his true and lawful attorney, to prosecute this claim. That he believes himself to be entitled to an increase of pension on account of not being rated proportionately to the degree of disability for manual labor. That he is suffering from the following named disabilities to wit; disease of heart and lungs, loss of the use of right shoulder result of vaccination, also rheumatism of affecting left hip and back also injury to right eye result of vaccination. That said disabilities are not due to vicious habits, and are to the best of his knowledge and belief permanent. HUFF, aged 35 years, a resident of Confluence, in the County of Leslie, and State of Kentucky, whose post office address id Confluence, Kentucky, well known to me to be respectable and entitled to credit, and who being duly sworn, declare in relation to aforesaid case as follows: That we have been well acquainted with said soldier, for 30 years, and 25 years, respectively, and that we were familiar with his physical condition during the period from November 10, 1883 until present time and knew him to be affected as follows: disease of right shoulder and heart disease, that said diseases are not due to vicious habits and that we know of same from personal observation. That the degree of disability for the performance of manual labor resulting from above causes, in our opinion, was during said time as follows, viz: about 1883 to 1890 Claimant was able to do about ½ of an able bodied man’s work; from 1890 to the present not more than ¼ work; and by sight is unable to do any regular work Said facts stated are personally known to us by reason of our having to reside in same neighborhood; seen claimant at frequent intervals and know of his condition of health well. That she is the widow of Wade Volentine, who was *** under the name of Wade Volentine, at ** on the 15th day of December, 1862, as Private in Company H, 14th Regiment Kentucky Cavalry, and honorably discharged March 24, 1864, having served ninety days or more during the late war of the rebellion. That the soldier was not in the military or naval service of the United States except as stated above That she was married under the name of Malinda Begley to said soldier at Middle Fork on the __ day of February, 1866, by John S. Begley; that there was no legal barrier to the marriage; that she had not been previously married; that the soldier had not been previously married. That the said soldier died December 24, 1902, at his residence; that she was not divorced from him; that she has not remarried since his death; that she is without other means of support than her daily labor and an actual net income not exceeding two hundred and fifty dollars per year. That she has not heretofore applied for pension. That she hereby appoints: ? Howard, Clerk Leslie County Court State of Kentucky, County of Leslie In the matter of the claim of Malinda Volentine, widow of Wade Volentine, Private Company “H” and “D”, 14th Kentucky Volunteer Cavalry, for pension under the amended act of June 27th, 1890, No. 781.533, personally appeared WOOLERY BEGLEY, aged 30 and MARTHA HUFF, age 19, both of Confluence, County of Leslie and State of Kentucky, both being duly sworn according to law, state in regard to the above entitled claim as follows: That we were both present at the residence of Wade Volentine on December 24, 1902, when he was violently prostrated from heart failure and died immediately, that the family had no time to summon a physician and no physician was had. Affiants are further able to state that the claimant lived with the soldier as his wife up to the time of his death, and that she has not re- married since. We further declare that we have no interest in said claim and are not concerned in its prosecution. We are further able to state that the claimant has no regular income and no means of support, except that rendered by one grown son who tills the farm and contributes voluntarily such assistance as she gets. We are further able to state that the claimant has no one legally bound to support her, and has no assistance except the voluntary help mentioned above We further declare that we have no interest in said claim and are not concerned in its prosecution. HUFF, aged 63 years, and BLEVINS HUFF, aged 52 years, both residing at Confluence, Kentucky and whose post office address is Confluence, Kentucky, Leslie County, both being duly sworn according to law state in regard to the above entitled claim as follows: That they were brought up in the same neighborhood with Wade Volentine and Malinda Begley and that neither ever contracted any marriage except that in which they were married together. That they lived together as husband and wife up to the time of the soldier’s death, and that the claimant has not remarried since Affiant’s are able to state the foregoing facts from having known both the soldier and the claimant intimately from childhood on up to the soldier’s death, and the claimant on up to the present, because of having lived in the same neighborhood and vicinity most all the time intervening. Personally came before me, a Deputy County Court Clerk, in and for the aforesaid county and state, J. M. MELTON, aged 37 years, and EDWARD McHONE, aged 25 years, both residing in the vicinity of Confluence, County of Leslie, State of Kentucky, both well known to me to be reputable and entitled to credit and who, being duly sworn, declare in relation to aforesaid case, as follows: That only about eleven (11) acres of the 140 acres owned by the claimant was under cultivation during the year 1903, and that the only crop raised was principally corn, only 5 or 6 bushels of Irish potatoes being raised. That about 250 bushels of corn was raised, worth $125 That no part of the crop has been sold and further no part of the farm has been rented during the year. That the claimant has no income from any other source than her farm, and that is inadequate for her support. That we are further able to state that the soldier had no life insurance in effect at the time of his death, and that he had made no will. Further there is no bible record of the marriage of the claimant to the soldier, as we are able to state from personal knowledge, and the claimant is unable to furnish the exact date of the marriage. Affiants are able to state the foregoing from personal knowledge obtained as residents in the same neighborhood as claimant, and from being on the farm and visiting the residence of the claimant’s frequently.
