Civil War Pension file of James Eversole DECLARATION FOR ORIGIANL INVALID PENSION State of Kentucky County of Clay On this 19th day of October, A.D. one thousand eight hundred and eighty 6, personally appeared before me, a County Clerk, a Court Record within and for the aforesaid, JAMES EVERSOLE, aged 52 years, a resident of County of Clay and State of Kentucky, who, being duly sworn according to law, declares that he is the identical JAMES EVERSOLE, who entered service under the name of James Eversole on or about the 5th day of January, 1861 as 1st Lieutenant in Company M of the 14th Regiment of Kentucky Cavalry commanded by Harrison Fields and was discharged at Camp Nelson, on or about the 4h day of March, 1864, by reason of expiration of term of service, that his personal description is as follows: age 52 years; height x feet x inches; complexion fair; hair light; eyes blue. That while a member of the organization aforesaid, in the service and in the line of his duty near Campbell’s Creek, in the State of Kentucky, on or about the _day of September, 1863 a tumor come on his back just below his neck caused by straining That he has not been employed in the military or naval service otherwise than as stated above except prior service in Company I, 8th Kentucky Volunteers. That since the 4th day of March 1864, he has not been employed in the military or naval service of the United States, that since leaving service his occupation has been that of a Lawyer. That prior to his entry into the service above named he was a man of good, sound, physical health, being when enrolled a farmer. That he is now disabled from obtaining his subsistence by manual labor by reason of his injuries above described, received in the service of the United States; and he therefore makes this declaration for the purpose of being placed on the invalid pension roll of the United States. Spurlock Sworn and subscribed before me this 19th day of October, 1886 James Marcum, Clerk Clay County Court AFFIDAVIT TO ORIGIN OF DISABILITY State of Kentucky County of Perry In the matter of the pension claim of JAMES EVERSOLE, 1st Lieutenant, Company M, 14th Regiment Kentucky Cavalry Volunteers, personally came before me, a County Court Clerk in and for the aforesaid County and State, SHADRACK STACY, of County of Perry, State of Kentucky, who, being duly sworn, declares in relation t the aforesaid claim that his age is 45 years, that he is the identical person who served as a 2nd Lieutenant in Company M, 14th Regiment Kentucky Cavalry Volunteers, and knows the above soldier, who was a member of Company M, 14th Regiment Kentucky Cavalry Volunteers, that on or about the 10th day of September, 1863, while in the line of duty, and without fault or improper conduct on his part, at or near Campbell’s Creek, State of Kentucky, said soldier incurred or was taken sick, was taken to the dwelling house of one Jesse Campbell while we was camped there. Said applicant was in command of our squad. When he was taken sick at said time and place I was the only officer with said squad. I had to take command of said squad. Lieutenant Eversole was sent to Booneville, Owsley County, Kentucky. I think it was about one month before I seen him anymore. He was complaining of his shoulder and arm. I think it was his right shoulder and arm. Often aching and hurting him like rheumatism. I heard him complaining time and again up to the time of being mustered out. I have seen him a few times since he is before me now. I am looking at him and the same side that is the right side of his neck down near his right shoulder. The same shoulder that I have heard him complain of while in the service together. There is a tumor or a lump growing there now, which he is complaining of at this time he is at this time complaining of the same right arm that he complained of when we were in the army together. Affiant further declares that he has no interest, direct or indirect, in this claim, and that he makes above statement from personal knowledge and by being a eyewitness of them as above stated. Attorney of the 15th district of Kentucky and after being first duly sworn by me states as follows: That he is personally acquainted with the applicant James Eversole and knows him to be the James Eversole who was 1st Lieutenant of Company M, 14th Regiment Kentucky Cavalry Volunteers and have knew him during and since the war. He has lived in the same town and County with him ever since the war except for about the last 3 years and also have seen him every 2 or 3 months during the last 3 years. H is now present. He has a lump or tumor *** his shoulders or his neck between the shoulder and neck. He has frequently heard the applicant complaining of rheumatism pain since his discharge from the army until the present time. I have seen him as much *** with him. He could not raise his arms to his head. I know these facts from my own personal knowledge having walked in the law office with him and riding about together and being with him a great deal. The applicant entered the service he was a farmer he is now engaged in the practice of law and I have no personal interest, directly or indirectly in this case. My post office address is Booneville, Owsley County, Kentucky A H Clark Sworn to and subscribed before me the 1st day of February 1887 AFFIDAVIT TO ORIGIN OF DISABILITY State of Kentucky County of Owsley In the matter of the pension claim of JAMES EVERSOLE, 1st Lieutenant, Company M, 14th Regiment Kentucky Cavalry Volunteers, personally came before me, a County Court Clerk in and for the aforesaid County and State, HIRAM FIELDS, of County of _, State of Kentucky, who, being duly sworn, declares in relation to the aforesaid claim that his age is 59 years; that he is the identical person who served as a Private in Company M, 14th Regiment Kentucky Cavalry Volunteers, and knows the above soldier, who was a member of Company M, of 14th Cavalry Volunteers, that on or about _ day of September, 1863, while in the line of duty, and without fault or improper conduct on his part, at or near Campbell’s Creek, State of Kentucky, said soldier incurred was taken down sick complained of a hurting in his right shoulder and neck or near his neck. He was taken to a man’s house by the name of Jesse Campbell and he was left there. I never seen him anymore until I seen him at Camp near Boonesville, Owsley County, Kentucky. He was complaining of his right shoulder or neck and continued to complain time and again continuously until mustered out at Camp Nelson. I have seen him a few times since mustered out and I still heard him complain of the same shoulder hurting him. He is before me now. He has a tumor or a lump near his shoulder his right shoulder or on his back near the neck. The same shoulder he complained of in the camps. I never was much acquainted with him until he volunteered in our company. He appeared to be a healthy stout able-bodied man free from any disease. Especially of the tumor on his back or shoulder or any hurting in his shoulder as above described at Campbell’s Creek as far as I know. I have seen him *** before that I never seen any tumor or lump, but after he was taken sick at Campbell’s Creek and complained of his right shoulder and neck then this tumor came. Affiant further declares that he has no interest, direct or indirect, in this claim, and that he makes the above statement from personal knowledge. Affiant’s post office address is as follows” Proctor, Kentucky Hiram Fields Sworn to and subscribed before me this 1st day of February, 1887 AFFIDAVIT TO ORIGIN OF DISABILITY State of Kentucky County of Clay In the matter of the Pension Claim of JAMES EVERSOLE, 1st Lieutenant, Company M, 14th Regiment Kentucky Cavalry Volunteers, personally came before me, a Justice of the Peace in and for the aforesaid County and State, THOMAS STIDHAM, of the County of Clay, State of Kentucky, who, being duly sworn, declares in relation to the aforesaid claim that his age is 54 years; that he is the identical person who served as a Private, Company L, 14th Regiment Kentucky Cavalry Volunteers, and knows the above soldier, who was a member of Company M of the 14th Regiment; that on or about September, 1863, while in the line of duty, and without fault or improper conduct on his part, at or near Campbell’s Creek, State of Kentucky, said soldier incurred was taken sick. I seen him and talked with him. He complained of his back and neck and shoulder his right shoulder. He was taken to a house of a man by the name of Jesse Campbell and on his back or neck near his right shoulder where he complained of it hurting him there came a lump or tumor. It was some time after that then before I seen him anymore. The next I saw of him was at or near Booneville, Kentucky. He still was complaining of his right shoulder and back and under these circumstances was when and where said lump or tumor came. I was acquainted with applicant for about ten years before he enlisted into said Company and Regiment. I traveled along the roads with him and have played with him and I have been with him time and again. He was a sound healthy able-bodied man free from any disease especially of tumor or lump on his back before he enlisted into said Regiment. After that and when I would be with him I heard him complain of his back and Right shoulder and lump or tumor continuously up to the time we was mustered out at Camp Nelson. Affiant further declares that he has no interest, direct or indirect, in this claim, and that he makes the above statement from personal knowledge. Affiant’s post office address is as follows: Ammie, Clay County, Kentucky his James Burns Thomas X Stidham Marian Hensley Sworn and subscribed before me this 24th day of February, 1887 A J Burns, JPCC State of Kentucky County of Clay In the matter and pension claim of James Eversole Personally appeared before me a County Court Clerk in and for the aforesaid County and State, JAMES EVERSOLE, late Lieutenant, Company M, 14th Regiment Kentucky Cavalry Volunteers, now a resident of Tanksley, County of Clay, State of Kentucky, well known to me to be reputable and entitled to credit and who being duly sworn declares in relation to aforesaid case as follows: That he is unable to comply with the requirements of the pension office as to furnishing medical evidence because when I first was taken sick at or near Campbell’s Creek with my back and right shoulder and said tumor first made its appearance there was no Physician present. We were on a scouting mission at that place. I have bought liniment and bathed the placed and my back and right shoulder. I never was treated by any physician for said tumor or back and right shoulder from that time to the present, instead I have bought medicines, liniments and treated myself for said tumor, back and right shoulder. July 9, 1887 Sir: I have the honor to acknowledge the receipt of your request of March 9, 1887, for certain information for use in the consideration of application for pension No. 588.337, and to return it herewith, with the following information from the records of this office. It appears from the rolls, &c., on file in this office that JAMES EVERSOLE was mustered into service of the United States as 1st Lieutenant, Company M, 14th Regiment of Kentucky Cavalry to date February 13, 1863, to serve __years or during the war. On the muster rolls of Company M of that Regiment dated February 28, March and April and July and August, 1863 (only rolls o file) Reports him present. And no returns for August, 1863. (first on file) to January 31, 1864 (last on file) Books of Company and Regiment including Hospital records are not on file. Burns, In and for the said State and County and after being duly sworn by me states as follows: That his age is 43 years. He further states that he is acquainted with the applicant James Eversole and knows that he is the same identical James Eversole who served as a soldier or 1st Lieutenant in Company M of the 14th Regiment of Kentucky Cavalry Volunteers. I was acquainted with applicant about 10 years before he enlisted in the said Company and Regiment. I have traveled along the roads with him. I have played with him and I have been with him time and again. I know he was a sound healthy able-bodied man free from any disease before he enlisted into the Regiment or Company above said especially of disease of a tumor on his back or hurting in his back and shoulders. I have been acquainted with him ever since he was mustered out at Camp Nelson and came home. I have seen him each and every year up to the present instant and he is before me now. I know he is not able to do more than one- forth manual labor. I know these facts as above stated by being an eyewitness of them and being personally acquainted with him. I cannot read nor write but only sign my own name and I always get someone to do my writing. I was not acquainted with JAMES EVERSOLE until after I volunteered in his Company. I became well acquainted with him and found him social and often saw him talking and mixing with the soldiers. I have often saw him strip and wash himself and there was not any bump or tumor on his back that I could discover although I often saw him naked. The first I ever heard him complain was at or near the mouth of Campbell’s Creek. There was a squad of us soldiers camped there then and there heard him complain of his shoulder hurting him. I heard him say there that the cause of his shoulder hurting him was from a strain. I think this was in September or October 1863 and he complained so bad that he was left there. The next time I saw him was at Boonesville, I think in December 1863 and he was still complaining with his shoulder and a lump or tumor came on the back part of his shoulder where he complained of the hurting. I have seen the lump several times. Since it first came. Cardwell Special Judge AFFIDAVIT TO ORIGIN OF DISABILITY State of Kentucky County of Clay In the matter of the pension claim of JAMES EVERSOLE, Lieutenant, Company M, 14th Regiment Kentucky Cavalry Volunteers, personally came before me, a County Court Clerk in and for the aforesaid County and State, County of Clay, State of Kentucky, who, being duly sworn declares in relation to the aforesaid claim that his age is 54 years; that he is the identical person who served as a 1st Lieutenant in Company M, 14th Regiment Kentucky Cavalry Volunteers, while in the line of duty, and without fault or improper conduct on his part said soldier incurred I am the applicant James Eversole. I have got Lieutenant Shadrack Stacy’s affidavit it is on file. Captain Harrison Fields is dead, I can’t get his affidavit, there is no comrade that I recollect of at this time that was present at the time and place spoken of in my application. They was a small squad of my own Company along when I was at the Mouth of Campbell’s Creek when I got my shoulder slipped down or strained. There was a small squad of soldiers from other Companies of our Regiment with me at that time and place. James Eversole Sworn to and subscribed before me this 1st day of December 1888 James Marcum, Clerk Clay County Court GENERAL LAW DECLARATION FOR THE INCREASE OF AN INVALID PENSION State of Kentucky County of Clay On this 15th day of September A.D., one thousand nine hundred and 3, personally appeared before me, a County Court Clerk within and for the County and State aforesaid, JAMES EVERSOLE, aged 69 years, a resident of Manchester, County of Clay, State of Kentucky, who, being duly sworn according to law, declares that he is a pensioner of the United States, enrolled at the Louisville, Kentucky Pension Agency at the rate of 17 dollars per month, by reason of disability from Rheumatism and tumor near the right shoulder incurred in the Military services of the United States while a 1st Lieutenant, Company M, 14th Regiment Kentucky Cavalry Volunteers. That he believes himself to be entitled to an increase of pension on account of Rheumatism in his left shoulder and arm and in both shoulder and in his neck which increases as he grows older. He is so bad with rheumatism that he is totally disabled from manual labor. That he was not employed in the military or naval service prior to except as stated above That he has not been employed in the military and naval service since he was mustered out of the 14th Regiment Kentucky Cavalry Volunteers as above stated That he hereby acts for himself as his own attorney, his true and lawful attorney to prosecute his claim. It has been a long time my recollection is not as good as it was when I was a young man. I was a soldier about the year 1863 or 1864 in coming from Camp Nelson to Camp Wild Cat I took measles, caught cold and they settled on my lungs and in my eyes. I never have been a sound- man from that day to this present instant. My eyes have taken spells at times and my eyes have never been well from that time to this present instant and as I get older they get worse. This is written by the affiant, James Eversole James Eversole Sworn to and subscribed before me this 31st day of May 1907 William Marcum, Clerk Clay County Court DECLARATION FOR PENSION State of Kentucky, County of Clay On this 21st day of May, A.D., 1912, personally appeared before me, a __ within and for the County and State aforesaid, JAMES EVERSOLE, who, being duly sworn according to law, declares that he is 78 years of age, a resident of Manchester, Kentucky, County of Clay, State of Kentucky and that he is the identical person who was enrolled at __ under the name of James Eversole, on the__ day of ___ 18__, as a First Lieutenant, Company M, 14th Regiment Kentucky Cavalry Volunteers in the service of the United States, in the Civil War, and was honorably discharged. That he also served in Company I, 8th Regiment Kentucky Infantry, for about 15 months. He states that he served in the both of the above named services, for more than 2 years and by reason of not having his discharge at present he herein asks the Hon. Commissioner of Pensions, to examine the records of his discharge. That he is a pensioner of the United States, enrolled at the Louisville, Kentucky Pension Agency at the rate of $20 per month, Certificate No. 436.482 That he is 78 years of age, having been born on the 12th day of April, 1834. That he was employed in the military service of the United States for about 2 years and 6 months in all to the best of his recollection. That he makes this declaration for the purpose of being placed on the pension roll of the United States under the provisions of the Act of May 11, 1912. He also makes application herein under the invalid clause of this act, and ask that he be pensioned at the rate of $30.00 per month for disease of right shoulder, (atrophy) which disables him. A B Hampton H F Farmer Subscribed and sworn to before me this 21st day of May 1912 William Rice, Clerk Clay County Court DECLARATION FOR WIDOW’S PENSION State of Kentucky, County of Clay On this 15th day of April, A.D. 1916, personally appeared before me, a Clerk within and for the County and State aforesaid, ELIZABETH EVERSOLE, aged 55 years, a resident of Manchester, County of Clay, State of Kentucky, who being duly sworn according to law, makes the following declaration in order to obtain pension under the acts of Congress granting pension to the widows of soldiers and sailors who have died by reason of wound or injury received, or disease contracted, in the service of the United States and in the line of duty. That she is the widow of JAMES EVERSOLE who was 1st Lieutenant, Company M, 14th Regiment Kentucky Cavalry Volunteers and was honorably discharged, and who died at his home in Clay County, Kentucky on the 12th day of April 1916 of and who was drawing a pension under certificate No. 436.482, at the rate of $30.00 per month. Claimant also asks for all accured money, due said soldier at date of his death. That the said soldier was not in the military or naval service of the United States except as stated above That she was married under the name Elizabeth Robinson to said soldier on the 4th day of October, 1883 by James Allen, at Columbus Robinson’s there being no legal barrier to said marriage; that she had not been previously married; that the said soldier had been previously married. That she was never divorced from said soldier, and that she has not remarried since his death. That the said soldier left the following named children under 16 years of age at the date of his death to wit: None That she has not heretofore applied for pension. That she hereby appoints with full power of substitution and revocation W.O.B. Lipps her true and lawful attorney to prosecute this claim. Her post office address is Manchester, Clay County, Kentucky Elizabeth Eversole Also appeared William Roach, residing in Manchester, Kentucky and Jeff Robinson residing in Manchester, Kentucky, persons whom I certify to be respectable and entitled to credit, and who, being by me duly sworn, say they were present and saw Elizabeth Eversole, the claimant sign her name to the foregoing declaration; that they have every reason to believe from the appearance of said applicant and their acquaintance with her of 50 years and 26 years, respectively, that she is the identical person she represents herself to be; and that they have no interest in the prosecution of this claim. His first wife was named Nancy Abner and his last one Elizabeth Eversole. Affiants also state that above named soldier James Eversole, and this claimant, Elizabeth Eversole, did live together as husband and wife from the time they were married, until the death of said soldier and they were never divorced from each other. They certify that they are not interested in the prosecution of this case. Affiants also state that claimant and said soldier did live together as husband and wife from the time they were married, until the death of said soldier and they were never divorced from each other.
