LAST WILL AND TESTAMENT
of
WILLIAM SMITH
WILLIAM SMITH, Will probated July, 1777, original
in Court House, Chesapeake, Virginia--
"IN THE NAME OF GOD AMEN I William Smith of the
county of Norfolk, being of sound Mind and Memory do make and
Ordain this my last Will and Testament in the form and manner
following------- I give to my beloved Mother Eunice Smith, all
and singular my Property and Estate---both Real and Personal,
including all Debts due to me by Books, Bonds, and otherwise
during her natural life, and after her Death it is my Will and
desire that the Land be equally divided between my Three
Brothers Samuel, John, and Richard in the following manner, that
is to say, the Two Plantations to be valued and the Two whom
shall incline to purchase shall pay to the Third their portion
of his One Third of the Valuation of the whole Lands in
proportion to the value affixed on each respective Tract of Land
and Plantation; But in Case my said three Brothers Samuel, John
and Richard should all be desirous of holding each a Piece of
Land there being but Two Plantations, I say in that Case my
desire is that they draw Lots to determine which two shall hold
the Lands; and to prevent any disputes that might arise between
the Two purchasers about choice, its my desire that they draw
for choice provided they cannot otherwise agree-- IN WITNESS
whereof the Testator hath hereunto Set his Hand and affixed his
Seal in the presence of us---

July Court 1777 the above Will was proved by George Callis one Witness and Ordered to be recorded as by Order Book by Mr. Holt a Lawyer's direction--- July Court 1778 the above said will was further proved and ordered to be recorded, as by Order Book.
