Will Book 1 – Pages 196, 197 Page 196 Will of Marion McIntosh Know all men by these presents that I Marion McIntosh of Bath Knott Co. Ky being of sound mind and disposing memory make this my last will and testament here on earth. I bequeath unto Allie McIntosh my wife all of the real estate that I now own or may hereafter own and all of the personal property that I now own or may hereafter own and she is to own said real estate her lifetime or until she gets married in case she gets married again it or at her death the real estate is to be disposed of in the following way. 1st I want James McIntosh my eldest son to have the home place and 1 acre of land around it and he is to pick any where he wants it start and is to include the house. 2nd I want Coy McIntosh my youngest son to have 3 cows and 3 pigs is to join James McIntosh in all above conditions and is to run up the deadway hollow with branch and is to be situated on the west side of the branch or right hand side of branch as you go up the branch. I want Willie McIntosh to have 2 acres and he is to select any place he wants to. I want Ishmal McIntosh to have 2 acres and he is next to select any place he wants. I want Samuel McIntosh 1 acre and he is next to select where he wants but is not to sell it to any body except my heirs. I want Ada McIntosh to have 2 acres and she is next to select where she wants. I want Eva Combs to have one acre and she next to chose any where she wants. I want Babe McIntosh to have 2 acres and is next to select where he wants but none of the above selections is not to b____ any of __dains until divided and I want all of the rest of my real estate divided equally among all my children at Allie’s death and at Allies death I want James McIntosh to be appointed administrator in case she dies before the youngest heirs are 21 years old. The said Allie McIntosh is to dispose of the personal property in the way she thinks best. Signed and sealed in the presents of Elam Hale and Virgie Hale this Feby 28, 1930.
His Witnessed Page 197 Knott County Court The last will and testament of Marion McIntosh deceased having been filed and offered for probate and it appearing that the deceased, Marion McIntosh, was at the time of his death, and at the time of the execution of said will a resident of Knott County and State of Ky. And it further appearing that said will was executed in Knott Co. Ky. And that the subscribing witnesses thereto to wit: Elam Hale and Virginia Hale are both residents of Knott Co. Ky. and are only the subscribing witness to said will and are material witnesses in that they each subscribing said will in each other presence and in the presence of said testator and at the request of him and that at the time he executed said will and that they each believe the testator was of sound mind and disposing memory at the date of the execution of said will. It is ordered by the court that said will heard the same is now probated and the same ordered certified for record which is done accordingly. W. A.
