LAST WILL AND TESTAMENT

NANNIE HOPKINS
Will Book 1 Page 130, 131, 132 I Nannie Hopkins, being of sound mind but weak body, do hereby make and declare this my last will and testament. First, I want all my debts if any I have and my burial expenses paid. Second, I will and bequeath to my beloved husband Estill Hopkins all my personal property whatsoever including and all my personal affects that I have now or may have at my death. Third, I will and devise to my beloved husband Estill Hopkins all my real estate whatsoever, that I have now or may have at my death except the tract or parcel hereinafter described to John S. Franklin and all real estate that may hereafter come to me by inheritance. Fourth, I will and devise to my beloved husband Estill Hopkins the following described boundary of land situated ??? being in Knott County, Kentucky on right Beaver Creek and its ??? and portionally described as follows. Beginning on a stone on the south side of main Beaver Creek on line between Hasadore Hall deceased and Hawk Hall, thence down the creek with the meander of same to the mouth of Isaac Branch, thence up said branch; sometimes known as the Sonny Quillen Branch with its meander to a large elm tree, thence a west course up the point to a marked stone, thence up the point to a marked white oak, thence up the point running with the center ??? to the top of the Knob, to a chestnut, ash, and sourwood, marked to Perry Martin's line or the W. J. Hall, deceased line, thence with said line to the creek, thence down the creek to a chinquapine ash, thence up the line with the said W. J. Hall line to the top of the hill, thence running with the top of the hill between Bates branch and Beaver Creek to Jeff Halls line, thence down the hill with said line to the creek, thence across the creek and up the line with Jeff Hall's line to the top of the hill thence running with the top of the hill to Has Halls line, thence running down the hill with said Halls line to the beginning, excluding from the above boundary, the following boundary hereinafter devised to John S. Franklin Article Number five. I will and devise to my beloved Uncle John S. Franklin the said tract or parcel of land excluded from the above boundary described in article four, which is situated inside the said above named boundary in Knott County, Kentucky on right Beaver Creek - Beginning in right Beaver Creek at the mouth of Arnold Fork, thence running up Arnold Fork thence running up Arnold Fork as it meanders to the upper end of the bottom between Arnold Fork and Isaac Fork thence across to the public road. Arnold Fork around back of the ???, thence running with said road to the public road that runs up Isaac Fork, thence down said public road to the mouth of said Arnold Fork including about four acres more or less. I name Estill Hopkins my sole executor to act without bond. I make and declare this to be my last will and testament and I do hereby sign, execute and acknowledge the same to be my said last will and testament in the presence of Hawk Hall and W. G. Breeding and I hereby request them to bear witness of the same and to sign their name hereto as such witness. All of which as signed, sealed, published and declared in the presence of said witnesses. Breeding State of Kentucky Knott County I Perry Martin, a notary public in and for the county and state aforesaid certify that the forgoing instrument of writing was this day acknowledged before me by Nannie Hopkins in the presence of Hawk Hall and W. G. Breeding, subscribing witnesses thereto, and was by the said Nannie Hopkins in said presence signed, published, and declared to be her last will and testament that the said witnesses signed their names as such in the presence of Nannie Hopkins and in the presence of each other. Given under my hand this 3rd day of April 1919. Perry Martin Notary Public Knott County My commission as notary expires on the 31st day of January 1922 Order Probate Regular Term Knott County Court 1" day, August 18, 1919 In the matter of the probate of the last will and testament of Nannie Hopkins, deceased It appearing to the satisfaction of the court from the evidence of Estill Hopkins, Hawk Hall, and W. G. Breeding that the deceased Nannie Hopkins departed this life on the 23rd day of July 1917 ??? at the time of her death in Knott County, Kentucky leaving as her last will and testament the forgoing instrument of writing which the said Estill Hopkins and John S. Franklin this day filed in this court and offered for probate. Whereupon came Hawk Hall and W. G. Breeding the subscribing witnesses thereto and after being duly sworn stated that the instrument of writing was and is the last will and testament of the deceased Nannie Hopkins and that the said Nannie Hopkins signed, acknowledged, and declared the said instrument of writing to be her last will and testament in the presence of the said subscribing witnesses Hawk Hall and W. G. Breeding, and that they the subscribing witnesses, signed and attested said instrument of writing as witnesses thereto in the presence of the said Nannie Hopkins and at her request and in the presence of each other. Now, therefore, it is ordered that the said instrument of writing is, and the same is now adjudged to be the last will and testament of the said Nannie Hopkins and the same is hereby admitted to probate as such and ordered to be recorded and admitted to court as the last will and testament of the said Nannie Hopkins, deceased.
