LAST WILL AND TESTAMENT
of
ANDREW J. GRIGSBY
Will Book 1 Page 143, 144, 145 In the name of God Amen. I Andrew J. Grigsby being of sound mind and memory but weak in body do hereby make and declare and publish this my last will and testament. Firstly - I will and devise to my dear wife Zady H. Grigsby for her natural life time the home farm where we now live containing three hundred acres more or less and lying on Ball fork above the mouth of Trace fork and known as the John Grigsby farm. Secondly - I will and devise to my dear brother Elijah Grigsby and his wife Jennie Grigsby and their heir after the death of my said wife Zady H. Grigsby the said home farm where we now live and described in article one to be theirs absolutely and in fee simple after the death of my said wife Zady Grigsby. Thirdly - I will and devise to my deal wife Zady Grigsby the Quicksand farm containing one hundred acres and which is fully described in a deed from John L. Grigsby to A. J. Grigsby of date Feby 24, 191(?0?) recorded in Knott County court office in deed book 32 page 437 with power to sell and dispose of the same during her life time. In the event my said wife Zady Grigsby does not sell or dispose of the same in her life time, I will and devise to my dear brother Elijah Grigsby and his wife Jennie Grigsby and their heirs the said Quicksand farm described in article two to be theirs in absolute for (???). I hereby will authorize and empower my said wife Zady Grigsby sale of said Quicksand farm as her own and if she not want to do so, then it is to go to my brother Elijah and his wife Jennie as above mentioned. Fourthly - I will and bequeath to my adult son (?Frank?) Grigsby one dollar as his full share of all my real and personal property and that is all of my property that I desire the said (?Frank?) Grigsby to have. I make declare and publish this to be my last will and testament and I hereby name my brother Elijah Grigsby executor of my said will to act without bond and I hereby request JW Duke, HH Smith and May Grigsby to witness this my last will and testament. In the matter of the Probate of the last will and testament of A J Grigsby, deed It appearing to the satisfaction of the court from the evidence of JW Duke and HH Smith that the deceased Andrew J Grigsby departed life on the -- day of Feb 1923 domiciled at the time of his death in Knott County, Kentucky, leaving as his last will and testament the above and forgoing instrument of writing which was this day filed in the court and offered for probate. Whereupon came JW Duke and HH Smith two subscribing witnesses thereto and after being duly sworn stated that the instrument of writing was and is the last will and testament of the deceased Andrew J Grigsby and that the said Andrew J Grigsby signed acknowledged and declared the said instrument of writing as his last will and testament in the presence of the said subscribing witnesses JW Duke and HH Smith and that they the said subscribing witnesses signed and attested said instrument of writing as witnesses at the request of said Andrew J Grigsby and that he signed said writing in their presence and that they signed same in his presence and in the presence of each other. Now therefore it is ordered that said instrument of writing is and the same is now adjudged to be the last will and testament of the said Andrew J Grigsby and the same hereby admitted to probate as such and ordered to be recorded and admitted to record as the last will and testament of the said Andrew J Grigsby. This 19th day of March 1923.
