WALTER CALFEE
Will Book 1 Page 168 Middle In the name of God Amen: I Walter Calfee being of sound mind and memory, but weak in body, do hereby make, declare and publish this my last will and testament. First: I will and bequeath to my deal son Walter Calfee, Jr., the sum of ($320.00) Three Hundred and Twenty dollars, which I this day place in the Bank of Hindman on Time deposit at the usual interest and I direct that the said Bank upon check drawn by my wife, Minta Calfee, pay to said Minta Calfee for the use and benefit of my said son Walter Calfee, Jr. the sum of Eighty ($80.00)--in two different checks one drawn in April and one in October for equal amounts for the years, 1927, 1928, 1929 and 1930 and the year 1931 the said Bank may so pay the interest accumulated thereon. Second: I will and bequeath to my dear son Walter Calfee, Jr. all my livestock and personal property whatsoever. Third: I devise and will to my dear son, Walter Calfee, Jr. all my real estate including farm where I now live which farm is bounded and described as follows: Lying and being on ??? Fork of Smiths branch of Carrs fork in Knott County Kentucky and being the same land conveyed to the testator Walter Calfee, Sr. by WB Smith and Nancy B. Smith his wife by deed. Will Book 1 Page 169 dated April 26, 1909 and recorded in Knott County Court Clerks office in Deed Book No 23 Page 290 which deed is referred to and made a part hereof, for ??? description of the land herein devised. Excepting from said boundary a small portion of land heretofore ??? by testator Walter Calfee, Sr. to Ezekiel Caudill. It is my will and so desire that should my son Walter Jr. die before becoming of age, then the said above described real estate is to go to my daughter Margaret Calfee and my son Nello Calfee, share and share alike. I desire that my wife and children have possession and live upon said land until my son Walter Calfee, Jr. becomes 21 years of age, and after that he has control. I hereby empower and authorize my wife, Minta Calfee, to lease said land for oil and gas, the rentals and royalties to be collected by her and used for the benefit of my son Walter Calfee, Jr. I will and devise to my son Walter Calfee, Jr. all my real estate whatsoever including all my interest in my fathers farm in Wayne County West Virginia. I bequeath to each of my children George Calfee, May Calfee, Ora Calfee, Tood Calfee, Carl Calfee, Tina Calfee, Mabel Calfee, Margarett Calfee, and Nello Calfee the sum of one dollar to be paid to them by my executrix at my death. I make, constitute and nominate my wife Minta Calfee my sole executrix to serve without bond. I make, declare and publish this as my last will and testament in the presence of H.H. Smith and B.C. Napier, and I request them to sign same as attesting witnesses, This October 19, 1925. Napier Will Book 1 Page 170 Knott County Court August Term August 16, 1926 In the matter of the probate of the last will and Testament of Walter Calfee This day came in open court H.H. Smith and Bernise Napier who stated that the forgoing instrument of writing this day filed for probate is the last will and Testament of Walter Calfee, the said will was written by H.H. Smith one of the subscribing witnesses thereto, and Walter Calfee, and B.C. Napier the other subscribing witnesses thereto, that same was signed by the testator in their presence and at his request was signed by H.H. Smith and Bernise Napier as witnesses thereto. It is therefore ordered by the court that the said will be filed, which is done and the same is probated as the last will and Testament of Walter Calfee and the Clerk of the Knott County Court is ordered and directed to record the same as the last will and Testament of Walter Calfee.
