LAST WILL AND TESTAMENT

H. H. AMBURGEY
Will Book 1 Page 145, 146, 147 I H.H. Amburgey of the County of Knott and State of Kentucky of the age of 70 years and being of sound and disposing mind and memory, do make, publish and declare this my last will and testament in manner following: that is to say that on this day I will bequeath and give unto my son John Amburgey one certain tract or parcel of land situated in Knott County State of Kentucky on Little Carr and being a portion of my home farm and bounded or described as follows, to wit.-- Beginning on a spruce pine about 30 feet from Little Carr on right side going up stream and below the water mill, thence a straight line crossing said creek to a black oak and beech on the point on left side of Little Carr, thence up the point and with the same to top of the ridge, thence up the ridge to line of Floyd Taylor, thence down the line with line of Floyd Taylor crossing Little Carr and up the hill with said Taylor line to the top of the point on left side of ??? ???, thence a straight line to the beginning. This my last will revoking all former wills by me at any time made. In testimony whereof I have hereunto set my hand and seal this 6th day of Oct. 1923. H.H. Amburgey as and for his last will and testament in the presence of us who at his request in his presence and in the presence of each other have subscribed our names as witnesses thereto. H.H. Amburgey of the County of Knott and State of Kentucky of the age of 70 years and being of sound and disposing mind and memory do make, publish, and declare this my last will and testament in manner following that is to say First: I direct my executor hereinafter named to pay out of my estate, all my just debts, all my just debts if any should remain after my death. Second: I give and bequeath unto my wife Dicie Amburgey all my real estate in and around the mouth of little Carr (with the exception of that portion I have this day willed to my son John Amburgey) which remainder of said tract consists of my home farm and bounded on the north by lands of W.B. Smith and Floyd Taylor, on the east by lands of Floyd Taylor and Riley Combs, on south by John Stamper, and the west by lands of John Stamper and W.B. Smith Third: I give and bequeath to my wife Dicie Amburgey one half interest which consists of my entire interest in a tract of coal and mineral lands, situated on Breedings Creek, which tract of land, which tract of land is know as the Tim Hagans tract of land and consisting of about 20 acres of coal & other minerals. Fourth: I direct that my executor Dicie Amburgey divide all my estate equally between all my children when she as ??? after my death as I am this day and in this my last will giving to her full control of all my real estate first above described. Fifth: I hereby appoint my wife Dicie Amburgey the sole executor of this my last will and hereby revoking all former wills by me at any time made. Sixth: I give and bequeath unto my wife Dicie Amburgey the full benefits of all money and debts I possess to use as she thinks best and proper so to do. Seventh: I give and bequeath unto my wife Dicie Amburgey all my personal property to use in the best manner she thinks proper. Eight: I request that my executor Dicie Amburgey erect tombstones at the graves of W.J. Amburgey, Elizabeth Amburgey, W.W. Amburgey, Alice Amburgey, R.C. Amburgey and his wife H.H. Amburgey.
