1886 to 1888 Court Records

At a regular term of this Court for Jessamine County, Ky began and held at the Court House in Nicholasville, Ky on Monday, August 16, 1886
Present W.H. Phillips P.J.J.C.C.


This day T.J. Overstreet appeared and produced in open court his certificate of Election to the office of Surveyor, and moved the court to permit him to qualify which being granted he thereupon took the oath as required by law, and together with Wm E. Combs, his surety, thereon entered into and acknowledged bond unto the Commonwealth of Ky conditioned according to law, which bond is approved by the Court and noted filed.

This day Leroy English appeared and moved the court to permit him to qualify as Constable District No 5, under his Election thereto, which being granted he thereupon took the oaths as required by law and together with L.F. English his surety thereon, entered into and acknowledged bond unto the Commonwealth of Ky conditioned according to law which bond is approved by the Court and noted filed.

Ella E. Lowry -- on petition to divide lands
The Court appointed herein this day made their report which is noted and filed, and which is ordered to be laid over for exceptions and this cause in conditioned.

Geo M. Barkley -- on pet. to divide lands
This cause is conditioned

S.P. Crutcher -- on pet. to close road
The Court herein appointed to close the road herein mentioned this day made their report, showing that the order of this Court directed to them, had been executed, and said road closed, which report is approved and this cause is dismissed. It is further ordered that the costs of this proceeding be paid by this county.

Lindsay Reynolds -- on pet. to open new road, ordered that this cause be continued.

On motion of W.B. Smith Sheriff of Jessamine County, KY - Leroy English this day appeared in open court and was duly qualified as Deputy for said Smith, Sheriff, as aforesaid.

Ida Oldham --
On Petition to divide lands
Ida Oldham and others having filed their petition in Court showing the ownership of said Ida Oldham and Mary McDavitt to 136 acres of land in Jessamine County, Ky bounded as follows: On the North by the Versailles and Nicholasville Turnpike on the East by the lands of Dr. J.W. Holloway and the heirs of John Garrison. On the South by the lands of Dr. J.W. Holloway and on the West by the lands of George Clevelands heirs and having frayed the cost for the division of said tract of land and the allotment to Mary McDavitt of her interest therein it is now adjudged that O.B. Huggins, Larkin McTyne and George Cleveland be and ---------

Settlement with Adm. of James Simpson
The foregoing Settlement was returned to Court at the present Term noted and filed, and ordered to be laid over as required by law for exceptions.

On motion of G.B. Mosely, Sheriff of Jessamine County, Ky, L.M. English this day appeared in open court and took the oaths as required by law as Deputy Sheriff of said county.

This day Henry Crow and George Crow appeared, and moved the court to permit them to qualify as the Executors of the last Will and Testament of Eli Crow dec'd, under provisions of said will, which being granted they thereupon took the oath as required by law and entered into bond unto the Commonwealth of Ky conditioned according to law, and no security being required on said bond under provisions of said will, none was given.

In motion of the Executors of Eli Crow it is ordered that M.B. Frazer, Geo D. Cooley and Talbert Crow be and they are hereby appointed and directed, any two of whom being first duly sworn, may act, do appraise the personal property of said Eli Crow dec'd, and they will return such appraisement to this court as required by law.

Ivan Werko Turnpike Company of Jessamine County, Plaintiffs vs Pet. Robinson Heirs, Defendants

The Report of the Commissioners filed herein at the last term of this court and laid over for exceptions, is now approved and confirmed and this cause is conditioned.

Ordered that Court be adjourned until Tuesday, January 18, 1887

H.H. Phillips -- on petition to open new Road.
Petition herein this day filed in open court and noted, and on motion of said H.H. Phillips it is ordered that John Atchison, Logan B. Arnold and T.J. Rhorer, any two of whom may act, being first duly sworn, be and they are hereby directed to view the way said H.H. Phillips -- proposes to open a new Road as follows, Beginning at H.H. Phillips gate and Extending along a land to a point where said lane intersects with the Alliance School House road at Isaac Corman's, and they are directed to report to this Court in writing at its next regular term, the route of said proposed opening of road, describing same by metes and bounds, ------- and distances, giving the names of all the owners and tracts of land over which same will pass and the conveniences and inconveniences both to public and private interest that would result from the opening of said road, and they are permitted to view other routes for said opening of road than that proposed, and report the route they prefer, giving their reasons for such preference, and for further orders said motion is continued.

This day L.M. English appeared in open court and made motion to be permitted to qualify as Constable of District No 5 in this county, which being granted he thereupon took the oaths as required by and together with L.F. English his surety thereon entered into and acknowledged bond unto the Commonwealth of Ky conditioned according to law, which bond is approved by the Court and noted and filed.

Ordered that Court be adjourned until Wednesday, August 22, 1888
