Inquest of Jury for Kinner Fowles for Mill - Deed Book C Pages 7-8
To the Honorable the county Court of Hickman county at their August term 1835 in session – we Thomas T Ously, WH Wade, Martin Nale, I.L. Davis, James Spicer, Paskil Vaughn, James Gwyn, Thomas G Swain, Andre Scott, James Robertson, DH Melner, Caleb Cromweld. Being summoned by the sheriff of said Hickman county to view the site where Kimmer Fowlkes proposes to build a water grist and saw mill on the little Obion in said county of Hickman county as the law directs to examine what lands may be overflowed by the erection of a dam for a water grist and saw mill and say to what damage it wild be of the several proprietors and whether the mansion house of any such proprietor or the offices curtilages or gardens thereunto immediately belonging or orchards will be overflowed also whether or in what degree fish of passage and ordinary navigation will be obstructed thereby, whether any and by what means such obstructions may be prevented and whether in our opinion the health of the neighborhood will be annoyed by the stagnation of the waters – In compliance with said Charge and oath been examined the lands above and below the place where said Fowlkes proposes to build said water and grist and saw mill and are of opinion that said Fowlkes has a few simple titles to the land on which he proposes to build said water grist and saw mill and have allowed said Fowlkes to build his dam thirty feet high from the low water mark and are also of opinion that by the erection of said dam that the lands on mansion house of any such proprietor or the offices curtilages or gardens hereunto immediately belonging or chads will not be overflowed and also that fish of the passage and ordinary irrigation will not be obstructed nor the health of the neighbors be annoyed by the erection of said dam all of which we respectfully report – Given from under our hands and seals this the 6th day of June 1835

The Commonwealth of Kentucky to the Sheriff of Hickman County, Greeting: You are hereby commanded to summon and impanel Twelve fit persons freeholders of the viainage to meet on the 6th day of June 1835 upon the lands of Kinner Fowlkes on the little Obion to examine what lands may be overflowed by the erection of a dam for a water grist & saw mill and say to what damage it will be of to the several proprietors & whether the mansion house of any such proprietors or the offices curtilages or guardians thereto immediately belonging or orchards will be overflowed also whether & in what degree fish of passage and ordinary navigation will be obstructed thereby whether by any and by what obvious such obstructions may be prevented and whether in their opinion the health of the neighbors will be annoyed by the stagnation of the waters and make due return hereof to the August term of our said county court and in this fail not under the penalty of 100£ and have then there this writ. Executed by summoning twelve legal Jurors whose names are impannelled on this writ who met at the mill seat designated and was charged and sworn according to law & examined said seat and made Report on the 6th day of June 1835.

I, Henry L Edrington, Clerk of the County Court for the county aforesaid do certify that the foregoing report on a writ of adequacy in favor of Kinner Fowlkes for loard to erect a water grist mill was on the 7th day of this month produced in court examined and ordered to record with the exception of the height of the dam which by the order of the court is only to be erected fifteen feet high instead of 30 feet which will more freely appear by reference to said order truly record in my office.
