Commonwealth vs Harmon Coates

Commonwealth of Kentucky, Hickman County and Circuit Set:

The GRAND JURORS duly empanelled, Sworn, and charged to enquire for said Commonwealth and the body of the County aforesaid at the July Term of the Hickman Circuit Court in the year 1839 upon their oaths present that Harmon Cote late of said county yeoman on the 15th day of July in the year 1839 in the county of Hickman and Circuit aforesaid did then and there unlawfully suffer & permit in a certain house in said county unlawful games at cards to be played in said house at which games dollars & bank bills & checks were then and there won and cost he the said Harmon Cote then and there being the tenant of said house to wit at the county and court aforesaid contrary to the form of the statue in that case made and provided against the peace and dignity of the said Commonwealth.

Information given by Lodowick Farmer and Henry Perkins both citizens of Hickman County & farmers, not of the Grand Jury.

To the Sheriff of Hickman County: --Greeting.

We command you to take Harmon Cote if he be found in your bailiwick, and him safely keep, so that you have him before the Judge of our Hickman Circuit Court, at the Courthouse in Clinton on the first day of our next October term, to answer an Indictment of the Grand Jury found against him at the July Term, 1839 for suffering and unlawful gaming in his house, being the tenant of said house and have then there this writ.

To the Sheriff of Hickman County, Greeting:
We command you to summon Lodowick Farmer and Henry Perkins to appear before the Judge of our Hickman Circuit Court, at the Courthouse in Clinton, on the 2nd  day of our April term, to testify and the truth to speak in behalf of the Commonwealth in a certain matter of controversy now in our said court depending, wherein the Commonwealth of Kentucky is plaintiff and Harmon Cotes is defendant, and this you shall in no wide omit under the penalty of £100 and have then there this writ.

Witness WHH Taylor, Clerk of our said Court, at the Court house aforesaid, the 29th day of November 1839, and in the 48 year of the Commonwealth.

We command you to summon R. Powell and JN Buckley to appear before the Judge of our Hickman Circuit Court, at the Courthouse in Clinton, on the 2nd  day of our April term, to testify and the truth to speak in behalf of H.Coates in a certain matter of controversy now in our said court depending, wherein the Commonwealth of Kentucky is plaintiff and Harmon Cotes is defendant, and this you shall in no wide omit under the penalty of £100 and have then there this writ.

Sheriff will permit said Cotes to give bail in the sum of six hundred dollars for his personal appearance here on the 2nd day of our next October term to answer said indictment.

You are likewise commanded to summon Lodowick Farmer and Henry Perkins to appear at the same time and place as witnesses on behalf of the Commonwealth.

Executed on Harmon Cotes and bond taken with FW Behn his security probond in classes, also executed on L. Farmer and Henry Perkins, this witnesses, this 22nd August 1839

Know all men by these presents that we Harmon Cote and FW Behn his security am held and firmly bound into the Commonwealth of Kentucky in the sum of $600 which payment will and truly to be made we find Cote and his heirs and assigns gaintly and severly firmly by these presents sealed in our hand and seals and dated this 22nd day of August 1839.
