Case #78 Alexander Caldwell and Stephen Hanna vs. Samuel Davis
Alexander Caldwell and Stephen Hanna, Merchants trading under the name of Caldwell & Hanna, state that Samuel Davis, deceased, purchased $137.00 worth of merchandise, and since that time has departed this life, and that Mary Ann Davis has asked to be made a defendant to this bill, and that he has left as his heirs, …late Davis; Sarah C. Smith, late Davis, and Joseph Smith, her husband; Dolinda P. Jopling, late Davis, and Chesley P. Jopling, her husband; Elizabeth Davis. Samuel Davis and Lyddia Davis, the said defendant, being entirely insolvent, but having one house and two lots in the Town of Clinton, and no other estate, Caldwell & Hanna pray that the lots and house be sold and the proceeds used to pay the above bill.

We command the Sheriff to summon Mary Ann Davis, Administrator of Samuel Davis, deceased, Susan Tarpley, late Davis; Sarah C. Smith, late Davis, and Joseph Smith, her husband; Dolinda P. Jopling, late Davis, and Chesley Jopling, her husband; Elizabeth Davis, Samuel Davis and Lyddia Davis, infant heirs of the Decendent, to appear before the Judge on the first day of their next April Term, to answer a bill against them by Alexander Caldwell and Stephen Hanna. Witness my hand this 10th day of February 1832.

Ellison A. Daniel, Guardian ad litem for Lyddia Davis and Samuel Davis, infant heirs of Samuel Davis, deceased, states that he knows nothing of the matter and calls for full proof.

Robert Turner answer the bills against the heirs of Samuel Davis, Deceased states that he knows nothing of the justness of the claim, but in relation to Lot No. 4 mentioned in the bill, states that in 1829, he purchased at public sale from the Trustees of the Town of Clinton, the above Lot, and executed a promissory note with James Turner as his security for the sum of $56.00, and that the Trustees executed a bond for the title of the lot, with the condition that Davis was to pay the original purchase money for the lot, and upon that event, the Trustees would issue him a legal title. He never paid any of this sum, and he prays that this answer be taken as a cross bill against the Trustees and that the lot be sold to pay the purchase money due. Sworn to in open court this April 1st, 1832.
