Terhune, Albert - Last Will & Testament (spelling and grammar
preserved)

Book B, pages 286-287
In the name of God amen, I Albert Terhune of the county of Fleming and
State of Kentucky do make and publish this my last will and testament in manner
and form following that is to say First It is my will and desire that after my
decease all my just debt, together with my funerals expenses be specifically
& punctually paid
Secondly I give and bequeath to my well beloved wife Nancy the use of
the farm on which I now live for and during the term of her natural life and I
further give her two feather beds, Bed steds & bedding which she is to have
the privilege of selecting also her choice of cows, and her choice of the
horses, her saddles & bridles 1 Bureau and cupboard with the furniture, one
table and candle stand all the cooking utensils together with 1 years
provision
Thirdly I give and bequeath to my son John Terhune one dollar which is
addition to what I have otherwise done for him is to be considered as his
portion of my Estate.
Fourthly It is my will that after my decease the whole of my personal
property not specifically devised be sold and the money arising therefrom after
paying my just debt, be equally divided among all my children, except my son
John Terhune as the part that would otherwise fall to him I give my grandson
Eugene C Terhune, which is one 9th part
Fifthly it is my further will that after my wife Nancy's death the land
shall be sold and the money arising therefrom be divided among my children as
follows to my Daughter Martha Clark, Mariah White, Susan Nolin, Elizabeth
McIntire, Sarah Duvall, Kerilla Hinton, & Hannah Evans all equal saith part
each and to my son Barnet Terhune two equal 9th parts
Sixthly and Lastly I nominate and appoint my friend William Blair and my
son Barnet Terhune Executors of this my last will and testament hereby revoking
all former wills by me heretofore made. In testimony whereof I have
hereunto set my hand and affixed my seal this 26th day of Sept. 1840

At a court held for Fleming County on the 22nd day of August 1842, This
writing purporting to be the last will & testament of Albert Terhune was
produced in court and proved by the oath of Robert Ewing a subscribing witness
thereto who also proved the attestation of Samuel T. Blair another witness
thereto to be the will of said A. Terhune and ordered to be recorded which is
duly done.
