The plaintiffs Willis
Hisle, Statutory Guardian for Edith Hisle, Mary Hisle, Simpson Hisle and
Frances Hisle, infants under the age of 21 years, and B.T. Crouch, Statutory
Guardian for Benjamin Webber an infant under the age of 21 years, and said
infants by their said Statutory Guardian respectively state that on the 22nd.
day of February 1856 one Jonas Webber so departed this life in Estill County,
and left the defendant Sarah Webber his wife and widow, and the infant
plaintiffs and the following defendants his heirs at law: to-wit: William Webb
and his wife Edith Webb, formerly Edith Webber; John Finnell and his wife Susan
Finnell, former Susan Webber; Hezekiah Bowman and his wife Elizabeth Bowman,
formerly Elizabeth Webber, Sanford Webber, Jones Webber Jr.; Isaac Baker and
his wife Naoma Baker, formerly Naoma Webber; Fountain Finnell and his wife
Polly Finnell, formerly Polly Webber. (The five latter are now residents of the
State of Kentucky) Phillip Webber who is dead and left the following as his
only heirs at law: to-wit: Augustin
Webber, William Webber, Manerva Wood, formerly Manerva Webber who intermarried
with the defendant James Wood, Absolam Webber, Edith Webber, Jones Webber,
Martha Webber and Thomas Webber, the four latter are infants under the age of
21 years.
The plaintiff Willis
Hisle states that he intermarried with Sarelda Webber, one of the children of
said Jonas Webber deceased, and that she is dead and left the following
children and heirs at law: to-wit: Edith Hisle, Mary Hisle, Simpson Hisle, and
Frances Hisle that each of said children are infants under the age of 21
years. He was appointed their statutory
guardian and has taken the oath and given bond for the faithful performances of
his duties.
The plaintiff B.G. Crouch states that one Simpson Webber was also a child and heir of said Jones Webber deceased, and that said Simpson Webber departed this life and left the infant plaintiff Benjamin Webber, his only child and heir at law, and that at the? term of the Oldham County Court this plaintiff was duly appointed statutory guardian for said Benjamin Webber. The plaintiff further state the said Jonas Webber Sr. deceased at the time of his death was the owner in fee simple and in the possession of about ? acres of land in Estill County on the waters of the Kentucky River, whereupon the said Webber resided at the time of his death, which tract of land is worth about $2,000 and as said Webber had ten children or representatives, each child's part is worth about $200. They state that the defendant Sarah Webber, the widow of said decedent, is entitled to dower in said tract of land, that the same has never been assigned or allotted to her. That it is to the interest of the widow and the heirs that her dower in said land should be allotted to her, and for the purpose of effecting said allotment, and that a summons issued against all the defendants to this petition and that the court appointed commissioners for that purpose according to the provisions of the law in such cases.

Nelson C. Tuttle, a native of Clark County, KY. was born March 8th. 1825. His father, William S. Tuttle, a native of Culpepper County, Va. was born February 14th. 1797. He was a farmer by occupation and came to Kentucky in 1800 with his parents, who settled at what is known as Dunaway's Station where he spent the remainder of his life and died May 5th.1857. Politically he was an uncompromising Whig. He served as magistrate under both the old and new constitutions, and at the time of his death was Justice of the Peace, as well as the administrator of many estates.
He married Nancy Conkwright
of Clark County, daughter of John and Keturah (Lewis) Conkwright,
natives respectively of
Mecklenburg County, N.C. and Virginia.
Five children were born to their union. The subject of this sketch being
the youngest.
John Tuttle, the
grandfather of our subject, was a native of Culpepper County Virginia, of
Scotch descent,
and located lands in Clark County, KY about 1801 where he lived until his death
having been for many years a tobacco inspector. He was a graduate of Williams College. The maternal grandfather of Nelson C. Tuttle settled on upper
Howard's Creek and took part in many of the fights with the Indians,so frequent
in those days.
Nelson C. Tuttle was reared on the home farm and received his education from the common schools and at home. He removed to his present location in 1847 where he owns 300 acres of fine blue grass land, well stocked. September 9/1847 he married Mary Ann Finnell of Estill County, KY daughter of John and Susan Weber Finnell, natives respectively of Culpepper county, VA. and Estill County, KY. Four children were born to this union; Susan J., William S., John N.C., and James A.
Politically Mr Tuttle is a Republican and was formerly a Whig. He served as constable under the old constitution and was county surveyor for four years. He was commissioned by Gov.Crittenden as Lieutenant of militia, and in 1880 was appointed by Gen. Walker Secretary of the Interior, to take the census of Goode's precinct. He has been called to administer many large estates, never failing to give entire satisfaction. He has been a Mason since 1848, a member of the Right angle Lodge, No.233, F and A.M. and was made a Royal Arch Mason in 1852, and is a member of the Winchester chapter no. 12.
The subject of the above
sketch died October 7/1887.

Bill slowly, driving the horse drawn wagon along an old, rutted, dusty dirt road with the eight children squatted around the casket; on a long trip to their mother's final resting place. With Bill, Katherine, John, and Augustine understanding the finality of death, Fountain & Louisa missing their mother thinking she has just gone away for a little while but would be back soon, James, Rhoda, and Frances Ellen wanting to do what children do best...play and laugh...being protected from grief by reason of their age and lack of understanding.

Murder Near Ford William
Merrill shot and killed Achilles Berryman late Sunday afternoon, near Ford. The
difficulty arose over a woman, to whom both were paying attention. Merrill is a widower with eight children.
Berryman's body was brought
to Richmond Monday for burial. Reliable
details can not be learned until the examining trial. Merrill was arrested and is in jail.

Bill was acquitted of the
murder charge with a verdict of self defense.
Subsequently, Bill left the area and his children never knew what
happened to their father, they did hear that he remarried and had more children.

the place or date of burial being identified on the certificate of death. June Ann Anderson Sipos, great
granddaughter, and other family members report that he is buried in the Stinson

On May 22, 1900, in Estill
Co., Kentucky, John was paid about seven dollars by Thomas Tipton for serving
as a guard under the Small Pox quarantine.
"A Double Tragedy"
reported by the Clay City Newspaper:
Louis Puckett and John
Merril engaged in a duel at or near Elkin's store at Iron Mound, Estill County,
Sunday and both were seriously wounded.
Merrill is dead and Puckett lays with gun shot wound in the bowels which
must prove fatal. An old grudge is said
to have provoked the trouble.

Merrill deceased, and she had a valid and subsisting claim for damages against
the estate of one Bluford Puckett deceased, on account of the willful,
malicious, negligent and wrongful killing of said John Merrill in Estill
County, Kentucky, on the 6th day of June 1904, by said Bluford Puckett.
She says that no
administrator has been appointed for the said Bluford Puckett, who owned at the
time of his death (which occurred on June 7, 1904)

Kitty Stone married Gus
Webber and lived in Estill County.
Kitty had red hair and Gus was a heavy-set man. They had several children whose names were:
John, Abe, Rhoda, and Sally.
As the children grew up,
Rhoda married a Mr. Hughes. At the age
of fifteen, Sally married William Merrill who was twenty-four years of age.
William Merrill's mother was
Linnie LOWRY MERRILL. He had two
brothers whose names were Jim and Jeff.
The Webbers gave Sally and Bill a little log cabin on their property. Bill farmed on his newly acquired farm for several years. Sally gave birth to several children. They were Katherine, Gus, John, Fount, Eliza, Garfield, and Rhoda. Bill decided to leave Estill County and he moved to Bourbon County, taking his wife and children. While in Bourbon County, Sally gave birth to her last child, a daughter whom was named Frankie.
In the year of 1890, Sally had typhoid fever and died leaving eight children. Bill took the coffin in a spring wagon with the children riding with him to Estill County to the Webber farm. There Sally was buried and Bill asked his mother and father-in-law if they would keep the four girls, Katherine, Eliza, Rhoda, and Frankie. The Webbers said they would.
Bill took his four boys, Gus, John, Fount, and Garfield. Bill stayed at the cabin on the Webber farm for a year. After the year ended, Bill asked the Webbers if they would keep little Garfield and he would take Gus, John, and Fount with him to live in Ford, Kentucky, (which is in Clark County on the Kentucky River). The Webbers kept Garfield and the girls. Bill left Estill County with his three older sons who were teenagers at the time.
Bill had not been in Ford long before he began dating a very young girl whose name might have been Susie HOWARD. Ford was a new thriving community which had a lumber yard of some size there. Its nearness to the Kentucky River helped it to grow with the traffic up and down the river. Bill was in his early forties while Susie was a teenager. This was not a serious romance but Susie had a boyfriend, a young man by the name of Achilles BERRYMAN. Berryman was jealous of Bill's attention to Susie and this caused trouble.
In the year, approximately 1894, Bill was in Madison County returning to Ford when he saw a baptizing on the Madison County side of the Kentucky River. At the shore was Berryman and when he saw Merrill coming across in his boat, he turned to his friends and said, "Here comes Merrill. Watch me make his tail fly!" Bill walked out on the boom logs which protruded out into the river. He was helping to guide the logs that floated down the river to the saw mill over at Ford. While Bill was beginning to get on the boom log, Berryman made a few unkind remarks about Bill and Bill retaliated in like manner. Then Berryman hit Bill with a chunk of wood across his shoulders knocking Bill to his knees. Bill quickly saw Berryman was going for his gun and Bill grabbed his own gun quickly out of his pants and shot Berryman between the eyes. Berryman fell dead.
Achilles Berryman was a
nephew of Dr. Berryman who had married Bill's daughter, Katherine.
The shooting was a shock to
the community. Upon the examining
trial, Bill was acquitted and declared that Bill shot Berryman in self-defense.
Word got back to the Webber farm. Gus Webber was in the field with Garfield, Eliza, and Rhoda. They were weeding the tobacco plants when a man came up to Abe and told him that Bill Merrill had murdered Berryman at Ford. When the three children heard that their father had murdered Berryman they began to cry because they feared that their father would be hung for the crime.
In 1894 Eliza left Estill
County and went to Ford to be with her father, Bill. Bill had just married a girl by the name of Callie. When Eliza arrived she found that her new
step-mother was pregnant.
Eliza lived part time with her father and part time with a cousin Myrtie Webber Elkin. Eliza did housework around Ford for people. Bill introduced her to three Vermillion young men who were bachelors. The eldest was Ben, then Colonel, and the youngest was George. The Vermillions owned several houses in Ford and also had a farm above Ford.
Callie Merrill gave birth to
a son, Hazelrig Merrill. Eliza was
interested in George Vermillion who was an extremely handsome young man -- tall
and curly black hair and eyes with a mustache.
The Vermillions were from Bath County and were the sons of Frank and Rachel Lunsford Vermillion. The three boys had two sisters, Molly and Lute. Molly was married to Sam SIDWELL and had five children: Herman, Morgan, Jake, Ella, and Walter. Lute was married to David DARLINGTON and had three children: Frank, Effie, and Rose. Rebecca Vermillion had died in Bath County in 1891.
The three sons moved to Ford where they heard that the property was cheap and yet good for growing tobacco. Ben married later Nannie JOHNSON who was nearly thirty years old and Ben was over thirty. Colonel who was thirty married a sixteen year old girl, Lizzie OAKS. After a time, Eliza married George.
George and Eliza had a son, Letcher, who was born around 1898. In February of 1901, Letcher died of pneumonia. In September, on the day of President McKinley's assassination, Eliza gave birth to Nancy Ellen. It is interesting to note that Eliza went by boat from Ford to her grandparents' home in Estill County.
In December 19, 1903,
Stanley was born. Stanley was born in a
small cabin a mile off the Boonesboro Road.
Catherine was the next to be born and then Shelby.
In 1909 they lived in a small house which was burned to the ground while they were working in the tobacco field. Ray was the next to be born. George built a house on the Ford-Hampton Road in 1910 which was large and comfortable for his ever growing family. Ruby was the next to be born.
However, in the autumn of 1911, George sold his farm and bought a house in Winchester on Pendleton Street. They lived there until March of 1913 and then moved to the Scobee Farm on the Grimes Mills Road in Clark County. While they lived there Eliza gave birth to her last child, Clay. The house nearly burned while living on the Scobee Farm. If it had not of been for Walter (Molly Sidwell's son) it would have burned to the ground.
March of 1914, they moved to the Parker Place also on the Grimes Mills Road. They lived there for two years. March of 1916, they moved to Clover Bottom in Woodford County. There they met Jack Chin who was with Governor Globe when he was assassinated in Frankfort in 1900. In march of 1917 they moved to Lexington on Mill Street. But in March of 1918, they moved to a 500 acre farm in Scott County. They made a fine profit on their tobacco and bought and built a house at Clifton in March of 1919. However, they only lived there two years and in March of 1921 they sold their farm and moved to Edwards Place but only stayed until December when they returned to Lexington on Mill Street again. On May of 1922, they left Lexington and moved to First and Chestnut in Louisville and there they lived in Louisville the rest of their marriage.

Mrs. Frances E. Lanhardt,
86, formerly of 314 E. Stewart, died at 8:10 p.m. Monday at the Americana
Nursing Center, Perkins.
The funeral will be at 1:30
p.m. Thursday at the Beck Memorial Home, with the Rev. Marshall Semingson
officiating. Burial will be in Evergreen Memorial Cemetery.
Visitation will be from 7 to
9 p.m. today at the funeral home.
Mrs. Lanhardt was born July
4, 1886, in Winchester, Ky., a daughter of William and Sally Weber Merrill. She
was married to Earl Anderson in 1909 in Bloomington. He died June 10, 1931. She
was married to Herman C. Lanhardt on March 28, 1934. He died September 4, 1965.
Surviving are a daughter,
Mrs. Dora Gibson, Marquette Heights; three sons, Delmar Anderson and Virgil
Anderson, both of Long Beach Calif., and Kenneth Anderson, San Diego, Calif.;
five step-children; a sister, Mrs. Rhoda Metzger, Lexington, Ky.;
13 grandchildren, and
several great-grandchildren and great-great-grandchildren.
A son, four brothers and
three sisters preceded her in death.
She was a member of Grace
United Methodist Church.

Graveside services for Miss Betty Jane Poer, 58, formerly of Covington, will be at 1pm Tuesday at Forest Lawn Memorial Park, Erlanger. Miss Poer was found dead in Baltimore, Md, in January but her body was not identified until Friday, She is survived be her father, John Sherman Poer, Covington, and a sister, Mrs. Irving Block, Cincinnati. The Allison & Rose Funeral Home, Covington, is handling the arrangements.
