Last Will and Testament of 

Kate T. (Price) Borders of Ashland, Kentucky

 

I, Kate T. Borders, of Ashland, Boyd County, Kentucky, being of sound mind and memory considering the uncertainty of this frail and transitory life do therefore make ordain, publish and declare this to be my last Will and Testament revoking all former Wills  heretofore made by me:

First:   After all my lawful debts and funeral expenses are paid I give and bequeath to the Board of Missions of the Methodist Episcopal Church South, a corporation duly organized and doing business under the laws of the State of Tennessee, the sum of $2000. which sum of money shall be hereby said Board invested and held as a permanent fund and the income from said sum alone shall be used perpetually for the education of a student for the Ministry in the schools of Brazil, each student hereby provided for shall be a native of Brazil and the sum of money hereby be quested or given shall be known as the Kate T. Borders(memorial Fund) and shall be held and kept separate and apart form the other moneys of said Board of missions, and shall not be used for any other purpose other than that heretofore named, said sum  of money shall be paid by executor to the treasurery of the said board of Missions and the receipt of the said treasure of said board and shall be a discharge of my said executor for the same.

Second: I give and bequeath to the Missionary Society of the Methodist Episcopal Church, a corporation created by the laws of the State of New York, the sum of $1000. which sum shall be by said Society held and invested as a permanent fund and the income arising from said sum alone shall be used by said Society perpetually for the education and schooling of students for the Ministry in said Church, each of the said Students shall be a native of India as far as possible to obtain, and the receipt of the Treasurer of said Society for said sum shall be a discharge of my Executor for the same.

Third:  I give and bequeath to my beloved Brother William Price of Ashland, Boyd County, Kentucky, the sum of Five Hundred ($500) Dollars, to have and to hold the same forever, I also devise and bequeath to my said Brother during his lifetime the use of my house and lots situated on Central Avenue between 19th and 20th Streets, Ashland, Boyd County Kentucky.

Fourth:  I give and bequeath to my beloved sister, Mary Ann Roy, of Celeste, Texas, the sum of Three Hundred ($300) Dollars, to have and to hold the same forever.

Fifth:  I give and bequeath to my beloved brother, Reazon Price of Platt City, Missouri, the sum of One Thousand ($1000) Dollars, to have and to hold the same forever.

Sixth:  I give and bequeath to my beloved Niece Lillie Atherton Miller, of Baxter Springs, Kansas, the sum of One Thousand ($1000) Dollars to have and to hold the same forever.

Seventh:  I give and bequeath to my beloved Niece Mrs. Grace B. Gibson, of New York City, New York, daughter of my Sister Tillie Bradford, deceased the sum of One Thousand ($1000) Dollars to have and to hold the same forever. 

Eighth:   I give and bequeath to my beloved Cousin Anna E. Maston, of Mountain Top, Luzerne County, Pennsylvania, the sum of Five Hundred ($500) Dollars, to have and to hold the same forever.

Ninth:  I give and bequeath to my beloved great Niece, Geneive W. Gibson, of New York City, New Your, daughter of Grace B. Gibson , the sum of Six Hundred ($600) Dollars, to have and to hold the same forever.

Tenth:  I give and bequeath to my beloved great Nephew Willie G. Bradford, and my Great Niece Helen Grace Bradford, children of the late Doctor W. G. Bradford, deceased, of Baltimore Maryland, each the sum of Six Hundred ($600) Dollars, to have and hold the same forever.

Eleventh: I give and bequeath to Russell B. Berker, son of Mr. and Mrs. B. O. Becker , of Ashland, Kentucky, the sum of Six Hundred ($600) Dollars to be applied on the payment of his education, to have and hold the same forever.

Twelfth : I give devise and bequeath to the Methodist Episcopal Church of Ashland, Kentucky, my house and lot situated on Central Avenue between19th and 20th Streets Ashland, Kentucky, after the death of William Price, who is to hold same during his lifetime as heretofore stated in paragraph, third of this will, this property is given to said church on condition that said church shall use and maintain it for the home of aged Women and for no other purposes.

Thirteenth:  I hereby instruct and request that my Executor hereinafter to be named shall have the power and authority to sell a certain lot that I own on Jefferson Street, Huntington, West Virginia, he may sell it in whatever manner in his judgment will bring the best price.  The lot is located on Jefferson Avenue, known as Kate T. Borders lot. 

Fourteenth: I hereby authorize and instruct my hereinafter named Executor to pay Reverend W. I. Canter, the sum of One Hundred and Fifty ($150) Dollars for his services and expenses in officiating at my funeral in event that he does not officiate at my funeral he shall not receive the said sum.

Fifteenth:  The balance and residue of all my property shall be equally divided between Russell B. Becker, and Reginald W. Becker, children of Mr. and Mrs.  B.O. Becker, of Ashland, Boyd County, Kentucky, to have and to hold the same forever.

Sixteenth:  I hereby nominate and appoint B. O. Becker, of Ashland, Boyd County, Kentucky, Executor of this my last will and testament hereby revoking all former wills by me made, said B. O . Becker for his services as executor shall be allowed the surety of one Thousand ($1000) Dollars no more and no less, to be full compensation for any and all services that shall be rendered by him as executor of this will.  He shall retain said sum out of the moneys that shall come to his hands and shall also be authorized to sell or discount any notes which may come to his hands.  If in his judgment it shall be for the best interests for the Estate. 

            In testimony hereof I have hereunto this day signed my name this 13th day of October, 1910.

Signed and executed by Kate T. Borders in our presence and acknowledged this to be her last will and testament and attested by us in her presence and in the presence of each other, this 13th day of October, 1910.

I, Kate T. Borders, of Ashland, County of Boyd, State of Kentucky, do hereby make publish and declare this codicil to my last will and testament dated October 13th 1910.  I hereby revoke and annul paragraph 12 of said will and in lieu thereof I hereby substitute the following, to be deemed and taken as if originally inserted in said will as paragraph12 respectively.  As stated in paragraph 3rd of  this will my beloved brother William Price, of Ashland, Kentucky is to have the use of my house and lot situated on Central Avenue between 19th and 20th Streets, Ashland, Kentucky, during his lifetime and after his death I hereby and authorize my executor too sell said property at the brightest price obtainable and divide the proceeds of the said sale equally between my niece, Grace Bradford Gibson of New York and my niece Lillie Atherton Miller of Baxter Springs, Kansas and my great nephew, William G. Bradford and my great niece Helen Grace Bradford, children of the late Dr. W.G. Bradford of Baltimore, Maryland, and in event that any one of these four heirs should die the surviving heirs  inherit same equally. I hereby ratify and confirm my said will in all other respects.

            In witness whereof I have hereunto set my hand this 6th day of November 1912.

Signed and acknowledged by the said Kate T. Borders as and for a codicil to her last will and testament in our presence and by us subscribed as attesting witnesses in her presence at her request and in the presence of each other this 6th day of November A.D. 1912

            I Ed S. Hughes Clerk of the Boyd County Court do certify that the foregoing instrument of writing purporting to be the last will and testament and codicil of Kate T. Borders deceased was filed June 28, 1915 at a regular term of the Boyd County Court and same was duly proven allowed and established as and for the last will and testament and codicil of the said Kate T. Borders dec’d and was ordered to be recorded as such.  See Court Order Book No.12 pages 217-218.  Whereupon the same together with this certificate has been duly recorded.  

                        Witness my hand this 14 day of July, 1915.
