Last Will and Testament of
Jacob Price
I, Jacob Price, of
First: Of my
personal property, I give and bequeath to my brother William, my writing desk
and bedroom set of furniture. The remainder
of my property, both real and personal, I authorize and direct my executor
hereinafter named, to sell and convey and convert into cash with in a
reasonable time after my decease and out of the proceeds thereof pay my funeral
expenses and all of my just debts And it is my desire that not to exceed one
Thousand ($1000) Dollars be used to purchase a lot in the Ashland Cemetery, and
in erecting thereon to my memory a suitable monument, the best that can be
purchased with the amount above named.
Second: After the payment of my funeral expenses and just debt and all the legal expenses connected with the proper execution of the wills, I hereby give and bequeath to my brothers and sisters living the following amount viz. Sister Mary Eight Hundred ($800) Dollars, Sister Emma, One Thousand ($1000) Dollars, sister Kate One Thousand ($1000) Dollars, Sister Tillie, One thousand ($1000) Dollars, Brother John, Five Hundred ($500) Dollars, Brother Reason, One Thousand ($1000) Dollars, Brother William, One Thousand($1000) Dollars.
I also give and bequeath to my nephew Joseph Price One hundred ($100) Dollars, niece, Lillie Miller, One hundred ($100) Dollars, to my nephew William Atherson, One hundred ($100) Dollars, to my niece Grace Bradford One hundred fifty ($150) Dollars, to my nephew, William Bradford One hundred and Fifty ($150) dollars.
Third: I hereby give
and bequeath to each of the following conjugations of the following churches in
I give and
bequeath to the Board of Trustees of the Methodist Episcopal Church, of
I give and bequest to my sister Kate in lieu of any and all claims for services rendered and attention given me during sickness or other time Three Hundred ($300) and I also direct my executor to pay to my sister Kate One Hundred ($100) for money paid by ? on furniture in my house.
Sixth: It is my will and desire that if any of the beneficiaries under this will shall contest and or all of the provisions there of or shall commence proceedings or take any steps to void any of the provisions of this will then such action on the part of said beneficiaries shall forever bar them from receiving any bequest under this will and the commencement of such proceedings to contest or void any of the provisions hereof shall forever revoke any bequest made to such contestants by this will.
Seventh: If after the payment of the bequests in this will there shall remain surplus enough to duplicate the bequests main in Sections 2d, 2d, 4th; then it is my will and desire that said bequest be so duplicated. And should there only be enough remaining to duplicate said bequests in said sections to the amount of 50%, then it is my will and desire that said bequests be duplicated 50%. But should there not be enough remaining to make 50% of said amounts then it is my will and desire that all of said amount remaining shall be divided among my brothers and sisters; pro-rata according to bequests to them in section 2d, And further, I do hereby constitute and appoint Robert ?Richerdson, Executor of this my last will and testament, hereby requesting and directing him to pay all the bequests in this will and the order in which they are named herein, and pay same as fast as property, real and personal can be converted into cash without sacrifice and I do here by give full power and authority to sell and convey all property real and personal of which I am seized in order to fully carry out the provisions of this will.

The foregoing instrument aforting purporting to be the last will and testament of Jacob Price was on the 28 day of December, 1891 produced to the Boyd County Court and da?y proven by the oath of John Russell Jr. and F.H Tuinan subscribing witnesses thereto and was by the said court allowed and established as and for the last will and testament of Jacob Price deceased and as such duly and admitted toward Thereupon said will and this certificate have been duly recorded in my office.
