Transcribed from Barren Co, Kentucky - Will Book 4, Pg 162 & 163
In the name of God. Amen. I, John Newland, of Barren County, Kentucky being weak in body but of sound and disposing mind and memory do make and publish this my last will and testament in the manner following:
1. I will and direct that my funeral expenses and all my debts be paid as soon after my death as possible out of money that I die possessed of, or may first come into the hands of my Executor.
2. I will and bequeath to my beloved wife, Amanda M. Newland, the place I now live on, together with the land I purchased of Percena Pursely, and the land I purchased of William Love Senr; and my two slaves Frank and Eiller; and my part coming to me from the estate of my father Joseph Newland, deceased, of Sullivan County, Tennessee; and all the money that I hold on men by cash notes except one thousand three hundred dollars; and my stock (horses, cattle, sheep, and hogs); household and kitchen furniture; and all to the amount of one dollar.
3. I will and bequeath to my son, Josiah Hume Newland, the place I purchased of Peter Dep laying in the county and state aforesaid on the waters of Beaver Creek to have his lifetime, then the land to go to his children by his second wife.
4. I will and bequeath to my daughter, Mary Ann Bradford, one thousand dollars in money.
5. I will and bequeath to my granddaughter Mary Liza Newland five hundred dollars in money to be on interest til the age of eighteen years.
Lastly, I do hereby nominate and appoint Jefferson Gorin my Executor. In witness whereof I do, this my last will testament, set my hand and seal this 29th day of July 1862.

State of Kentucky - Barren County Court - December Call Term 1863 The foregoing instrument of writing purporting to be the last will and testament of John Newland decd, was on the 21st Dec 1863 produced in open court & proven by the oath of John C. Deweese, one of the subscribing witnesses thereto; and was further proven on the 25th Nov by Joseph B. Newberry, another subscribing witness thereto. Where upon the same was ordered to be recorded as the true last will & testament of John Newland decd. Attested R. B. Evans clk
Note: The will was faithfully transcribed even to the mis-spelling of Peter Depp's name, however punctuation was added for clarity. There is a $200 arithmetical error in the will in that he gave all cash, after expenses, to his wife except for $1300; then bequeathed $1500. This was $200 more than he had left to distribute. Perhaps this error was introduced as the will was copied into the Will Book after being proved in court. Jim Newland
