This indenture made and entered into the first day of November 1855 Between OZIAS HOGG & his wife NANCY HOGG late NANCY BERRY of the one part & FRANKLIN BERRY & EPHAIM BERRY of the other part all of the county of allen & State of Kentucky witnessth that the party of the first part for the consideration of one hundred & ten dollars to them in hadn paid the Recipt of which is hereby acknowledged. Doth this day ??? gaines and sold unto the party of the snd part their heirs and assigns ?? undivided one fifth part of the lawful interest of JAMES P. BERRY ??? in and to a Certain tract of land in the County fo Allen State ?? Ky & on the waters of Big Barren River it being the Same the ?? deeded to SARAH BERRY Mother of the aforsd JAMES P. BERRY by SAMUEL WHITNEY and Reference to Said deed from WHITNEY here made for the Bound & Buttes of the Same the Interest owned by JAMES P. BERRY decd one of the legal heirs of SARAH BERRY dec'd being the one undivided sixth tract of Said Survey from From WHITNEY to SARAH BERRY decd to have and to hold the one fifth of the interest of JAMES P. BERRY dec'd in and to Said land as discribed land unto the said FRANKLIN & EPHAIRM BERRY & their heirs & assignes forever & ?? the party of the first part will for?? warrant the Right & title to the aforesaid interest above ??? free & Clear form the Claime or Claims of all persona In ??? of all which we the party of the first part hath hereunto ?? our names the date above written.
