The Will of John W. Burkhart
1909 Pulaski County, Kentucky

I John W. Burkheart of Shopville Pulaski county Kentucky being of sound and disposing mind and memory do hereby make and publish this as and for my last will and testament hereby revoking and making void every and all other will or will by me at any time heretofore made.

First I direct the Executor to pay all my funeral axpenses and just debts and the expense incident to the administration of my estate as soon as reasonably may be after my decease.

Item I give devise and bequeath to my daughter Mary M Burkhart as follows: The land bounded as follows Beginning at a black gum, thence South to a sugar tree at the branch , thence South, South West to a white oak on the hill, thence West to a point in line opposite a large rock in the field above the house now occupied by Lacy S Burkheart, thence to said rock, then to a gate near house occupied by Lacy S Burkheart, thence to the Beginning. One mare, one cow, all the contents of the house now occupied by her. Said Mary M Burkheart is to have one fifth of all moneys left after funeral expenses just debts and other expenses have been paid. Said Mary M Burkheart is to have four board trees off of the lands give and bequeathed to Lacy S. Burkhart Sarah C. Herrin the children of Mandy J. Estep and the children of Liza Ann Randall.

Item I give and bequeath to my son Lacy S Burkhart one fourth of the land not hereinbefore bequeathed. Said Lacy S Burkhart is to have one fifth of all moneys left after funeral axpenses, just debts and other axpenses have been paid.

Item I give and bequeath to my daughter Sarah C Herrin one fourth of the land not hereinbefore bequeathed to Mary M Burkheart. Said Sarah C Herrin is to have one fifth of all moneys left after funeral axpenses just debts and other axpenses have been paid.

Item I give and bequeath to the children of Mandy J Estep deceased one fourth of the land not hereinbefore bequeathed to Mary M Burkhart. Said land to be equally divided among them. Said children of Mandy J Estep is to have one fifth of all moneys left after funeral axpenses just debts and other axpenses have been paid. Said moneys to be equally divided among them.

Item I give and bequeath to the children of Liza Ellen Randall (deceased) all the lands not hereinbefore bequeathed. Said lands to be equally divided among them. Said children of Liza Ellen Randall is to have one fifth of all moneys left after funeral axpenses just debts and other axpenses have been paid. Said moneys to be equally divided among them.

Item, Moneys received from the sales of farming implements & shop tools is to be equally divided among Mary M Burkhart Lacy S Burkhart, Sarah C Herrin, the children of Mandy J Estep deceased and the children of Liza Ellen Randall deceased that is if any moneys be left after funeral axpenses just debts and other axpenses have been paid.

In witness whereof I have hereunto set my hand this seventeenth day of February A.D. 1909. Signed published and declared by John W Burkhart the above named list also as and for his last will and testament.

In the presence of us who at his request in his presence and in the presence of each other have hereunto subscribed our names as witnesses.

I Dan'l Borden clerk of the Pulaski county court do certify that the above and foregoing instrument of writing purporting to be the last will and testament of John W Burkhart deceased was at the March term 1909 of the Pulaski county court produced in open court and proven according to law by the oath of Geo. Adkins and George Surbur the two attesting witnesses thereso and the court being sufficiently advised doth adjudge the same to be the last will and testament of John W Burkhart deceased and as such ordered to be put to record which is done accordingly.
Given under my hand as clerk oforesaid this March the 17th 1909.
