84 year Old Contract of Sale, Executed In Fleming Co., Kentucky

E. A. [Eugene Alexander] Caywood, who lives at 1907 Kansas Street, Woodward, recently brought to the office of The Woodward Daily Press a faded copy of an 84 year old contract of sale executed between his parents and his mother’s father in Fleming County, Kentucky.

It is an interesting instrument and is being published verbatim, spelling, capitalization and all:

Fleming County, ky. March the 1st. 1861.

“Know all men by these presents that I have Bargained & Sold to Mason Caywood and Elizabeth Ann Caywood His Wife A Tract or parcel of Land Lying & Situated on the Waters of Johnson & in the County & State above mentioned & bounded as follows Beginning In the Branch & in the County Howards Corner it being the corner of the tract of land that I Bought of Howard Thence running N.E. Crossing the Creek with said original Line & in the same direction to Elsa Hanicans line Thence N.W. with said line to L. D. Stouts Corner on the South Side of the Branch Thence with his line to a white oak & poplar Chas. Hanicans Corner in the Direction of the Creek Thence with the Line Between Chas. Hanican’s tracts of land & the tract that I Bought of J. P. Howard with its Mianders Corners & e to the Line Between Adamson or Reese & Hannicans tract about 60 Sixty or 65 Sixty five acres Now for the above described tract of Land The aforesaid Mason is to pay Cash in hand Sixteen Dollars per acre for each and every acre of Land Contained in Said Boundary The number of acres to be Determined by Survey & for The amount of money that may be left unpaid on the first day of April next the Said Mason Caywood is to pay interest from the date hereof The Said Caywood is to pay me at Least Two Hundred Dollars each year on or before the first day of March until the amount Sixteen Dollars per acre with the interest thereon is paid – I agree & Bind myself Heir assne – Executors or Administrators then to make them Mason Caywood or Elizabeth Ann his wife Their Heirs or assne a good & Sufficient Deed to Said tract of land with all & singular the apportainances there unto in testimony where of I Set my hand & affix my Seal date first above written.
